The Impact of ‘Rule of Law’ on Economic Performance : An Empirical Study on Hayek Hypotheses

The principle of Rule of Law has well been established, beginning with Albert V. Dicey, and then, with momentum of Friedrich A. Hayek, as one of the most fundamental norms in modern states, from which every individual economic activity through market process flows. Institution matters, and the rule of law also purports that it can be important institution to determine economic performance. If so, it’s marvelous that there have been so scanty studies on the influence of rule of law on economic performance, and, worse in terms of quantitative analysis on the topic. This paper treats rule of law in terms of economic not legal context, and tests its role on economic performance. First of all, basic values of rule of law were identified in terms of liberalism(classical meaning): substantial and procedural values. Substantial values require law to be general, abstract, certain. Procedural values require the exercise of state power under the constitutionalism, rule-based decision making, neutral principle. These core concepts of rule of law render this study to stay in the liberal context. Data on relevant variables were collected from Worldwide Governance Indicators of World Bank Group. Then, Hayekian hypothesis on common law(“Common law is superior to civil law in that the former is associated with the fewer government restriction and more individual economic liberty”) was tested. Common law family states were treated as dummy variable and given 1, and others 0. Dependent variable(individual economic liberty) was redefined as three sub-concepts: liberty itself, the base of the liberty, the result of the exercise of those liberties. The result proves Hayek was right. Finally, by using path model influence of rule of law on the economic performance was tested. Rule of law proved to be powerful variable to economic performance(GDP measured in terms of purchasing power parity), while the participation in democratic political process was found to be detrimental to it. As was pronounced by New institutionalism Economics, the rule of law as an critical institution do matters, with positive effect on economic result.

법의 지배(Rule of Law)는 다이시 및 하이에크 이래로 근대 국가의 핵심적 법 원리로 확립되어 있다. 자유 시장 경제 하에서도 경제 행위는 법의 제약을 받으므로 법의 지배는 경제행위에 직접적인 영향을 주며 나아가 국민 경제의 경제적 성과에 대해서도 영향을 준다. 그러나 법의 지배가 법 해석의 은유를 넘어 경제에 주는 성과에 관한 실증 연구는 국내외적으로 극히 희소하여 경제성과의 원인을 충분히 설명하지 못하고 있다. 이 논문은 법의 지배와 관련된 가설들을 검증함으로써 법의 지배가 경제에 미치는 효과를 경험적으로 검증한다. 우선 법의 지배가 갖는 본질적 가치를, 법의 지배의 태생적 근원인 자유주의 이념의 토대에서 실체적 측면과 절차적 측면에서 명확히 규명하였다. 한편, 법의 지배가 개인의 자유 및 나아가 경제성과에 영향을 준다고 하더라도, 그 작용은 법체계의 토대 즉 ‘법계’(法系 legal family)에 따라 달리 나타날 수 있다. 따라서 법의 지배가 경제성과에 영향을 준다는 명제를 검증하기 이전에, 보통법 체계가 개인의 자유에 더 기여한다는 하이에크의 가설을 국제 자료를 통해 검증하였다. 그 결과 보통법 체계는 개인의 자유를 더 증진한다는 하이에크의 가설은 올바른 명제로 확인되었다. 그리고 나아가 법의 지배가 경제성과에 주는 영향을 경로 모형(path model)을 통해 검증하였는데 여기서는 법의 지배와 더불어 정치참여 변수가 경제성과에 주는 영향도 함께 분석되었다. 그 결과, 법의 지배는 경제 성장에 강력한 독립변수임이 확인되었고 제도가 경제성과에 중요한 원인임을 재확인하였다. 이에 비하면 정치 참여는 경제 성장에 오히려 부정적 영향을 미친다는 결론을 얻었는데 그것은 참여의 강화가 이익집단 정치를 통한 지대 추구 확산, 재분배 정책의 경쟁적 도입을 지향하여 경제 성장을 저해하는 것으로 해석할 수 있다. 법의 지배는 많은 도전을 받고 있으며 가장 강력한 도전인 ‘복지국가’는 그 본질상 법의 지배와 상충되는 것이다. 법의 지배가 법뿐 아니라 경제성과에 긍정적 영향을 주는 작용을 감안하면, 법의 지배에 대한 모든 의도적, 비의도적 위협으로부터 법의 지배 원리를 확고히 지키는 것은 개인의 자유와 사회의 부의 증진을 초래하는 기반이 될 것이다.
