The purpose of this study is to examine whether school foundations who have been entrusted with the compulsory middle school education by the superintendent of Seoul Office of Education, have the responsibility on sharing the expense at the compulsory middle school education. To attain this purpose, researcher analysed the features of the compulsory education and the legitimate share, reviewed the laws and regulations in regarding to these issues, and analysed the decision of administrative litigation on the legal claim raised by the six school foundations against superintendent of Seoul Office of Education. This study concluded that school foundations have no responsibility on sharing the expense at the compulsory education and suggested the urgent amendment of laws and regulations in regarding to the expense at the compulsory education entrusted to private school foundation and the legitimate share of it.

이 연구는 의무교육을 위탁하여 실시하고 있는 학교법인이 법정부담경비를 부담할 책임이 있는지를 분석하는 데 목적이 있다. 이를 위하여 의무교육비와 법정부담경비의 성격 및 관련 법령의 내용을 고찰하고, 학교법인과 서울시교육감 간에 진행된 의무교육 위탁 사립중학교의 법정부담경비에 관한 소송의 판결내용을 분석하였다. 이 연구에서 의무교육비와 법정부담경비에 관한 법령, 학교법인회계와 수익용 기본재산 수익 및 법정부담경비 부담 실태, 의무교육비와 법정부담경비의 쟁점에 대한 판결내용, 의무교육 위탁 학교법인의 수익용 기본재산 확보에 대한 법제처의 유권해석 등을 종합한 결과, 중학교 의무교육을 위탁받아 시행하고 있는 학교법인은 법정부담금을 부담할 책임이 없음을 밝혀졌다. 또한, 의무교육을 위탁시행하는 학교법인의 법정부담금 관련 법령의 개정이 시급히 이루어져야 함을 제언하였다.
