The purpose of this study was to provide basic materials for establishing DWI deterrence traffic policy by analysing the factors of deciding the sentence to the DWI offenders. Data of 584 drivers' written opinion of investigation from Gumjung police station in 2006. For the analysis Data Mining method, especially Exhaustive CHAID Model, was conducted. The result of Data Mining method showed that the most important factor of deciding the sentence to the DWI offenders is whether existing of drivers' records on the pre-sentenced for DWI offend or not. If drives had a DWI offend record, they were sentenced a heavy fine. Secondly, whether driver's occupation is related to the transportation business or not, their being licensed or unlicensed, having a traffic accident records or not, were important factors. This study had two major limitations. First, socioeconomic variables such as education level, marriage status, and economic condition were not controlled. Second, the study area was constrained to only one city, which put restraint on generalization of the study results. Nevertheless, this study made valuable contributions in that the impacts to the DWI Sentencing was proved using Data Mining method. Also, this study first attempted to make an analysis for impact factors to the DWI Sentencing.

본 연구는 음주운전자에 대하여 선고하는 형벌의 경중결정에 음주운전자의 어떠한 요인이 영향을 미치는 지에 대하여 분석함으로써 음주운전을 억제할 수 있는 정책수립에 도움이 되는 기초자료를 제공하고자 하였다. 이를 위하여 음주운전으로 인하여 처벌받은 전력이 있는 운전자 584명에 대한 수사기록인 의견서를 대상으로 하였으며, 음주운전자의 인적사항을 토대로 교통경찰전산자료인 TCS(Information Management System for Traffic Cop)에서 운전자의 운전경력 변수를 추출한 후, 데이터 마이닝(Data Mining)방법을 활용하였다. 분석결과, 음주운전 형량 경중의 결정에 음주운전 전력이 가장 큰 영향을 미치고 있었으며, 운수업여부, 무면허여부, 교통사고 경력 유무가 영향을 미치는 것으로 나타났다. 경찰서 의견서에 국한되어 혼인상태, 경제사정 등의 사회경제적 변수를 고려하지 못하였다는 등의 한계가 있지만 본 연구문제에 있어서 국내에서는 흔히 사용되지 않았던 데이터 마이닝 기법을 적용하였으며, 실제 음주운전자의 자료를 바탕으로 하였다는 점 등에서 기존의 국내․외 연구들과 차별되는 의미 있는 연구였다.
