To protect suspects’ rights in the criminal procedure is important standard whether a country is a civilized community of law. But, there have been lots of problems with koran police custody system. This study involved analysis of related advanced researches, review of legislations about police custody, current custody system condition and improvement strategies of police custody system. The results are referred below. As an aspect of legislations construction, the abolition of the alternative jail is needed to be considered progressively. To change the office of primary responsibility from the criminal investigation section to the police administration division is also needed to be considered. And an independent special law with police custody should be evaluated. As an aspect of management details, human rights friendly physical examination is essential. And it's needed to improve level of both facilities condition and sanitation. If suspects could be notified their rights to be medically cared, it's helpful to improve suspects' rights. Additionally, problems of inadequate and poor feeding should be ameliorated. It's expected related future studies will be followed.

형사절차에서 피의자ㆍ피고인의 인권보장 규정과 그 실현의 정도는 한 나라의 인권보장의 수준과 실상을 판단함과 동시에 문명국의 수준을 가늠하는 중요한 잣대가 되고 있으나, 우리 경찰의 유치장 관리와 관련하여서는 끊임없이 많은 문제가 제기되어왔다. 이 연구에서는 유치장을 둘러싼 그 간의 연구들을 검토하고, 관련 법제를 분석하며, 유치장과 관련된 이론적 토대를 정리하였다. 나아가 현행 유치장 운영 실태 및 문제점을 고찰하여 현황을 개관하고, 관련 문헌과 외국의 사례를 종합하여 인권친화적 개선방안을 모색해보았다. 주된 논의결과를 요약하자면 다음과 같다. 우선 법제 구성적 측면에서는 대용감방의 유지로 인한 문제가 지속적으로 제기되고 있으므로, 궁극적으로는 이의 변경ㆍ폐지가 필요하다. 또한 유치장 업무도 전문성이 필요한 분야이므로 수사부서가 아닌 별도부서에서 관장할 수 있도록 하여 직무전문성을 높일 수 있는 방법도 모색되어야 한다. 그리고 경찰서 유치장에 관한 독자적이고 체계적인 내용의 법률이 존재하지 않고 여기저기 각종 법령이 산재되어 있어서 많은 문제가 발생하고 있는 바, 독립된 단행 법률이 제정될 필요가 있다. 운영 실제적 측면에서는 인권친화적인 신체검사 노력이 증대되어야 하고, 유치장의 시설을 전반적으로 개선하고, 위생 수준을 높일 필요가 있다. 나아가 처우 프로그램의 확충이나 의료적 처우를 받을 권리의 고지제도 등도 고려될 만하다. 기타 관식비의 상향조정 등을 통한 급양 수준이 개선이 검토되어야 한다. 추후에 이 연구의 부족한 면이 보완되는 보다 구체적인 연구들이 지속되어서 관련 제도가 선진화되기를 기대해본다.
