The results of this study provides that there should be detailed discussion on the election system of the superintendent to enhance local self-government and educational autonomy. First of all, they need to be ultimately integrated to expand and strengthen decentralization of education and self autonomy as there are conflicting issues in basic point of view, policy, and method of operation about educational autonomy. However, it is desired to form a consensus between the two as there has been a tight confrontation between advocates of integration and separation. Also, the improvement of election system of superintendent is desirable along that line to promote liaison and cooperation of the two. In addition, implications of this study include improvement in the election system of superintendent by reviewing its history of change and several case studies of leading countries. In specific, the election policy has been changed and suggested in a variety of ways according to the political circumstance of the time for the past 60 years. However, it was a direct election system of superintendent that has been in the center of introduction and also innovation of local educational autonomy; prior to local self-government, system of appointing superintendent was conducted for about 40 years, followed by beginning indirect election system of superintendent and local self-government for 16 years since 1991. To sum up, history of changes in election system of superintendent has been revised to represent residents and their control. Meanwhile, the election system of several leading countries showed a wide variety; however, among them policy of appointing was mainstream, integrated with local self-government and educational autonomy. In conclusion, direct election system by residence is an ideal type to realize the principle of control by residence. However, It's not still sufficient to guarantee the connection between the local self government and the educational autonomy system. Therefore, I propose it is time to examine the new alternative for superintendent election system such as the running mate with local governors, nomination system, and direct election by limited residence, etc.

본고에서는 현행 교육자치 개혁의 연장선상에서, 그리고 지방자치와 교육자치의 연계를 강화하는데 있어서 가장 핵심적인 요소가 되는 교육감 선거제도가 그동안 어떤 문제점들을 제기했으며, 향후 어떻게 개선되어야 하는지를 논의해서 그 바람직한 방향과 대안을 제시하고자 한다. 본 연구의 결과로 볼 때, 지방자치와 교육자치의 연계를 위한 교육감 선거제도 개선에 관련하여 다음과 같은 논의가 이루어져야 할 것이다. 첫째, 교육자치에 대한 기본 시각, 정책, 그리고 운영방식의 차이점이 대립되어 있는 상황에서 교육분권과 자치의 확대‧강화를 위해서는 지방자치와 교육자치는 궁극적으로 통합되는 것이 바람직 할 수 있다. 그러나, 양 기관의 통합론과 분리론의 대립이 팽팽한 만큼 양측의 공감대를 형성해 나가는 동시에 보다 실효성있는 교육자치제도의 개선을 위해서는 우선 양자간 연계와 협력을 강화해 나가는 것이 필요하다. 지방자치와 교육자치의 연계와 협력이 강화되려면 무엇보다 교육감 선거제도의 개선이 반드시 전제되어야 한다. 둘째, 본 연구에서는 지금까지의 교육감 선거제도의 변천과정, 주요국의 사례 그리고 지난 선거결과의 문제점들의 분석을 통해 제도 개선에 대한 필요성과 시사점을 도출하였다. 교육감 선출방법은 지난 60여년 동안 당시의 정치적 배경에 따라 다양하게 변천되고 제안되어 왔다. 그러나 교육감 임명제를 실시하던 지방자치 이전의 40여년과 1991년 지방자치 실시와 더불어서 교육감 간선제를 실시한 16년 동안에는 교육감 직선제의 도입이 지방교육자치제의 도입 및 개혁의 중심이었다. 즉 교육감 선거제도의 변천은 주민대표성을 높이고 주민통제의 원리를 강화하는 개정방향이었다는 사실이다. 한편, 주요국의 교육감 선거방식은 다양하지만 지방자치와 교육자치가 통합된 가운데 임명제방식이 주류를 이루고 있다. 결론적으로, 주민직선제 제도상의 장‧단점은 있을 수 있으나, 현행 교육감 직선제가 심각한 문제점들을 제기한 상황을 감안하고 외국의 사례들을 고려하면 현행 주민직선제 방식은 그 개선이 반드시 필요하다고 할 수 있다. 그 대안으로는 시‧도지사 러닝메이트제, 시‧도지사 임명제, 그리고 제한적 주민직선제 등이 교육감 선출방식의 새로운 대안이 될 수 있다.
