The Purpose of this study is to strengthen the systemicity and concreteness the functional limit of the State Contract Law, the basic law for construction industry and the law for the strengthening of fairness in the relation with subcontract, as comparative study with the european and german public procurement law system. The legal system of the public construction contract work is in the situation, in mutual relation there are deficient its systemicity and concreteness. From this reasons the three Acts can not guarantee the Fairness in subcontract of the public construction services. On the contrary, because the german construction services contract is based on trust, at the construction services, a building contractor have to complete the construction personally. Therefore, in European and German the Subcontract is regarded as a exception in the public construction services. Through the comparative study we can lern that for the Strengthen of fairness of subcontract in public construction services, it is demanded, in the relation of the State Contract Law, Law of Fairness for the Subcontract, Elementary Law for Construction Industry the systemicity and concreteness to tighten. And then in relation with Strengthen of fairness of subcontract the following details are required that actualization of the Personal contribution, actualization and concreteness of the conditions of subcontract.

한-EU FTA가 잠정 발효됨에 따라 우리의 공공건설 도급제도는 두 가지 측면에서의 도전 이 제기되는 바, 첫째는 공공건설 도급과 관련 우리 법제도의 정비를 통한 공공건설분야의 경쟁력 강화가 시급히 요청되고 있고, 둘째는 우리의 관련 업체들이 27개 EU 회원국으로 진출하는 경우, 해당 국가의 관련 법제에 대한 이해가 요구되고 있다. 본고는 이러한 환경 변화에 대응하기 위한 기초적인 연구라 할 수 있다. 본고는 크게 두 가지 측면으로 연구되었는데, 첫째는 EU 법제에서의 공공건설 도급제도 에 대한 조망이고, 둘째는 이를 바탕으로 독일법제에서 공공건설 도급제도의 구체화이다. 본고는 특히, 이들 양자의 법제속에서 우리의 건설 하도급상의 불공정 현실을 극복하기 위 한 시사점을 발굴하는 데 초점을 두었다.우리의 국가계약법,하도급공정화에 관한 법률, 건 설산업기본법 등과의 관계속에서 몇 가지 교훈을 제시하였다.
