Periodic diversification of information industrialization and pluralistic society shows phenomenon of legislative conflict that be accompanied to the gain and loss relationship of individual group in a problem of legislation. Change of the society always demands the demand of new legislation. After democratization of our society, National Assembly does a duty the open space of various views. The result of evaluation as member of the Assembly has influence that be elected in the next election. As such reason, Members of the Assembly endeavors for the legal proposing that be accompanied to gain and loss relationship of local constituency and the group which has a relationship. As the result, It was made a quantitative expansion of member of the Assembly legislation in the flood time of the legislation. As the result which disregards a qualitative legislation during that time, our society failed in demand forecast with discord of opinion of each one group about legislation and in demand forecast to legislation which relates with the important policy of the nation. The group which is estranged from relation legislation accompanies a big psychological panic condition. Also even in the group which comes to accept with the gain and loss relationship, the person concerned couldn't meet sufficiently requirements which is caused by legislation. In legislation process of our country, the Assembly legislation when trying to compare with the governmental legislation shows differently. Today, the faithlessness legislation which is caused by with the legislation participation, the legislation leaning with the Interest group which is force, the legislation which made with a political consideration Is appearing. In order to solve the problem of legislation like this, the National Assembly must change legislation system, employ the legislation specialist, and must accomplish one legal theoretical systematic legislation evaluations in order to be adapted to our periodic situation and social cultural situation. As the result, The many citizen will be able to sympathize in qualitative legislation and optimization law of National Assembly.

정보산업화와 다원주의사회로의 시대적 다변화는 입법의 문제에 있어서 국민개별집단의 이해관계에 수 반된 개별집단별 욕구충족에 수반하여 다양한 입법을 둘러싼 갈등현상을 나타내면서 물리적 충돌로 나타 나고 있다. 사회의 변화는 항상 새로운 입법의 수요를 요구한다. 우리사회의 민주화이후 의회가 다양한 공론의 장으로 기능을 수행하고 의원개개인의 의정활동평가가 재 선을 담보하는 상황으로 나타난 결과 의원들이 소속지역구나 관련 집단의 이해관계에 상응하는 법률안발 의에 목을 매고 있다. 그 결과 의원입법의 양적팽창이라는 입법의 홍수시대를 맞이하게 되었다. 그동안 질적 입법을 도외시한 결과 우리사회는 국가의 주요정책과 관련한 입법에 있어서 개개집단간의 의사의 불일치와 입법에 대한 수요예측에 실패하여 관련입법에서 소외된 집단에게는 엄청난 심리적 공황 상태를 수반하기도 하였고, 관련입법에서 이해관계당사자로 받아들여진 집단에게도 입법으로 인한 충분한 욕구의 충족이 이루어지기 힘든 상황이 많이 발생해왔다. 세종시법과 첨단과학 벨트법에서도 보았듯이 우리사회는 주요정책과 관련한 입법에 있어서 지역 간ㆍ계 층 간ㆍ이해관계 집단 간 첨예한 대립과 반목으로 사회경제적 소모전을 벌이며 정치적ㆍ이념적 갈등으로 변질되어 이해관계가 다른 집단 간에 심각한 상처를 남기고 상당한 경제적 손해를 발생시켜왔다. 현재에도 몇몇 법률안과 관련하여 그러한 양태를 보이고 있는 상황이다. 우리나라의 입법과정이 정부입법과는 달리 의원입법에 있어서는 입법관여자의 전문성부족과 선심성입법 등으로 인한 부실입법, 힘있는 이익집단으로의 쏠림입법, 정치적 고려에 의한 포퓰리즘적 졸속입법의 형태 로 법률이 만들어짐으로서 상당히 심각한 사회문제로 대두되고 있다. 이러한 입법의 문제를 해결하기 위해 서는 우리의 시대적 상황․과 사회문화적 상황에 조화할 수 있도록 입법시스템을 시급히 개선하고, 전문적인 입법지원인력을 확충함과 동시에 정치한 법이론적ㆍ체계적 입법평가를 통하여 국민다수가 공감할 수 있는 질적 입법으로서 ʻ최적화 법률ʼ을 만들어 나가야 할 것이다. 첨예하게 대립ㆍ갈등하는 국민들의 의사가 잘 조정ㆍ조화되고, 국민들의 다양한 의사를 적극 수렴한 ʻ최적화 법률 또는 최적의 법률ʼ은 우리의 입법경쟁 력을 강화함으로써 복잡하게 급변하는 현대다원화사회에서 우리사회발전의 큰 원동력으로 작용할 것이다.
