The correctional studies in Korean lies in providing discourse with philosophy, ethics, literature, religion through humanistic approach, and is widening the horizons by scientizing corrections. This paper pays attention to the public-common of people that is appearing at corrections, and searches meeting of corrections and public philosophy that seek publicity philosophically. That will be create new correctional discourse. This paper illuminated paradigm of criminal justice in view of public philosophy that points to 活私開公(empowering the public by animating the individuals) and self-other-public world. The change process of paradigm of criminal justice (retribution→restitution→restorative) might be interpreted 滅私奉公(selfless devotion to one’s country)’ justice→滅公奉私(a virtue of out of selfishness)’ justice→活私開公(empowering the public by animating the individuals)’justice. I understood that restorative justice is common ground for meeting of public philosophy and corrections. And I confirmed that public world can be outspread in restorative justice. This study is preliminary observation to clear that humanization of corrections is a first consideration for socialization of corrections and scientization of corrections,

최근 한국의 교정학은 인문학적 접근을 통해서 철학을 비롯해서 윤리학, 문학, 종교와 담론의 장을 마련하면서 그 지평을 교정의 과학화로 넓히고 있다. 본고는 최근 교정의 영역에서도 나타나고 있는 민의 공공성에 주목하고, 공공성을 철학적으로 탐구하는 공공철학과 교정과의 만남을 통해서 새로운 담론을 창출하려고 한다. 이를 위해서 공공철학이 지향하는 공, 사, 공공의 삼원론과 활사개공과 자기-타자-공공세계의 관점에서 사법 패러다임을 조명하는 작업을 하였다. 그 결과 응보적 패러다임→보상적 패러다임→회복적 패러다임으로 발전해 온 사법 패러다임의 변천과정을 멸사봉공형 정의→멸공봉사형 정의→활사개공형 정의로 해석하고, 회복적 사법을 공공철학과 교정과의 만남을 위한 접점으로 이해하였다. 그리고 회복적 사법에서만이 공공철학의 중요 개념인 공공세계가 펼쳐질 수 있음을 확인했다. 본고는 교정의 인간화가 교정의 사회화와 교정의 과학화를 위한 선결문제임을 밝히기 위한 예비적 고찰이 된다.
