Domestic violence becomes such a serious social problem, not individual, to the point that the police must be obliged to intervene with their problems. Therefore, the police's active steps are needed to prevent recidivism of domestic violence and their initiative actions are regarded as choices to stop the secondary victimization. Thus, we should recognize the seriousness of the violent situation and that it is important for the police to intervene with their problems actively. But in terms of legal system, the intervention of the police toward recidivism of the family violence is not clearly identified and the prejudice of domestic violence . In conclusion, this study shows that the habitual cause of domestic violence and theoretic surroundings on family violence and the police's response. Also, based on the surroundings of theory, we analyzed how serious domestic violence was through analysis of examples and recognized how imperative its solutions are. The solutions which this study shows to us are as followings. First, The police and people should improve the social awareness about domestic violence. Second, The special act regarding domestic violence is to be revised. With the upgraded legal basis, the capability that the police have in reacting domestic violences should be enhanced to arrest the attackers on the spot. Third, It is necessary that the police be connected with outside agencies to play their role properly.

가정폭력은 단순히 가정 내의 일이라고 생각하거나 다른 범죄에 비해 범죄라는 인식이 부족하여 지속적이고 상습적인 범죄임에도 불구하고 겉으로 드러나는 통계적 비율이 적다. 그러나 가정폭력의 심각성을 생각할 때 어느 범죄 못지않게 그 피해의 정도와 재발의 위험이 크다고 볼 수 있다. 이에 경찰의 가정폭력에 대한 초기대응은 가정폭력을 예방하고 제2차 피해를 막을수 있는 매우 중요한 대안 중의 하나라고 보여 진다. 따라서 가정폭력 실태와 심각성을 인식하고 일선 경찰이 현장에서 보다 적극적인 자세로 개입하는 것이 무엇보다 가정폭력을 예방하고 재발을 방지하는데 중요하다. 그러나 법제도적 측면에서 경찰의 가정폭력에 대한 개입 내용이 명확하지 않고 가정폭력에 대한 선입견과 편견이 가정 폭력의 경찰 대응에 있어서 적극적 개입을 힘들게 하고 있는 실정이다. 이에 이 연구의 이론적 배경을 토대로 가정폭력의 원인이 무엇이고 얼마나 심각한지를 사례분석을 통하여 그 문제점을 분석하였고, 그 문제점으로는 우선 경찰관과 일반시민들의 가정폭력에 대한 인식의 개선이 필요하고, 타 기관과의 연계가 미흡하여 사후서비스가 이루어지지 않으며, 신고가 들어와도 경찰의 적극적인 해결의지가 부족하여 가정폭력이지속되게 만드는 원인이 되고 있다고 보여 진다. 따라서 가정폭력에 대한 지속적인 폭력을 예방하기 위해서 여러 가지 법적․제도적 정비와 아울러 경찰관 및 일반인의 사회인식을 개선할 수 있는 교육 및 지속적인 홍보 등이 필요하다.
