In order to regulate the organized crime frist of all it is necessary to formulate the concept of organized crime. But even now it seems that definite and unified concept of the organized crime is not formulated. And it's concept is diverse according to each country's situation. So I studied the present state about it and tried to formulate the definite concept of organized crime. Such a effort like that is not only necessary to cooperate investigation but also vital to legislate for regulation. In this study to begin with I considered the concept of the organized crime in United States of America, Germany, Italy, Japan, China(including Hongkong, Macao and Taiwan) and Korea. In the conclusion I tried to formulate a new concept of organized crime.

갈수록 심각해져가는 조직범죄를 규제하기 위하여는 우선 조직범죄에 대한 개념의 정립이 무엇보다도 필요하다. 그러나 아직도 전세계적으로는 조직범죄에 대한 명확하며 통일된 개념의 정립이 되어 있지 않다고 볼 수 있으며 각국의 실정에 따라 다른 개념으로 나타나고 있다. 따라서 이에 대한 현황을 고찰하여 조직범죄에 대한 명확한 개념정의를 시도하였다. 이는 갈수록 늘어가며 더욱 치밀해져가는 국제적 조직범죄에 대한 각국의 수사공조에도 필요할 뿐만 아리라 국내에서도 각종 규제입법을 하는데 있어서 긴요한 일일 것이다. 본 논문에서는 우선 미국과 유럽 중 독일과 이탈리아, 그리고 아시아에서는 일본과 중국(홍콩, 마카오, 대만 포함) 그리고 우리나라에서의 조직범죄에 대한 개념들을 살펴보았으며 결어에서는 필자의 조직범죄에 대한 개념정의를 시도하였다.
