The juvenile probation system is considered to be the best policy for the treatment of juvenile offenders among the policies until now and the criminals can be educated and guided by the direction and supervision of the probation officers under the community service order or under the attendance center order etc. The purpose of this study is to propose the most effective tasks of probation for juvenile offenders and delinquents in the respect of probation Identity in Korea. To meet the purpose of the study, the current situations and problems of probation for juvenile offenders and delinquents were analyzed. Also the directions and tasks of probation for juvenile offenders and delinquents in the respect of probation Identity were proposed as below: 1) establishment of the probation identity by welfare model beyond justice model for juvenile offenders and delinquents 2) application of the value for restorative justice 3) promotion of efficient rehabilitation programs 4) diverse use of the probation programs for supervision - such as Intensive Probation Supervision, boot camp, electronic monitoring, subdivided community services and attendance order, etc. 5) proper revisions of probation related laws 6) development of civil-public partnership for proper probation systems 7) adoption of various professional probation workers for juvenile offenders and delinquents.

이 논문의 목적은 2007년 소년법 개정 이후 소년보호관찰제도가 안고 있는 여러 문제점을 짚어 본 후, 제도의 발전 방향을 보호관찰의 정체성을 중심으로 제시하 고자 한 것이다. 현행 소년보호관찰제도가 안고 있는 문제점으로는 첫째, 소년 임시퇴원자나 가석방자의 보호관찰에 대하여 규정하고 있는 법의 내용을 살펴보면 보호관찰처분이 임의적 인지, 아니면 강제적인지 명확하지 않다는 점, 둘째, 지도·감독과 원호활동의 비실효 성 문제, 셋째, 각종 조사제도간의 관계가 미비하며, 문제보호소년에 대한 사 후관리제 도가 효율적이지 못하다는 점, 넷째, 부족한 인력 문제로서 업무의 과부하와 전문성 결여 등과 같은 문제들이 나타나고 있다는 점 등을 지적하였다. 그리고 이러한 문제점을 해결하기 위한 소년보호관찰제도의 발전 방향을 보호 관찰 정체성을 중심으로 다음과 같이 구체적으로 제시하였다. 즉, 1) 보호관찰의 새 로운 정 체성의 확립: 정의모델을 넘어선 복지모델의 확대 필요 2) 회복적 사법의 가치 활용 3) 사회복귀 프로그램의 효율성 제고 4) 분류처우와 중간처우제도의 구축 5) 보호 관찰 법규의 개정 6) 보호관찰제도에서의 민관협력체제 강화 7) 소년보호관찰 전문 인력의 확충 등이 그것이다.
