To improve the efficiency of reorganization in Korean integrated bankruptcy law that is the official procedure in corporate restructuring, comprehensive injunction, a just routine procedure, should be replaced by automatic stay and also debtors' meeting should be upgraded to debtors' committee with appropriate authorities. Therefore, the committee could actively participate the reorganization process and invest the seed money to the insolvent companies with other investors through DIP financing system, then the blue chip companies, which is undergoing liquidity crisis temporarily affected by unpredicted and precipitous economic condition change, could overcome it rapidly, so the Korean corporate bankruptcy system will be called the genuine reorganization system.

기업 구조조정에 있어 공적 절차인 통합도산법에 따른 기업회생절차 의 효율성 을 극대화하기 위해서 형식적 절차에 불과한 포괄적 금지명령제도를 자동중지제 도로 대체할 뿐만 아니라 채권자협의회를 채권자위원회로 격상하고 그에 따른 권 한을 부여함으로써 채권자들이 기업회생절차에 적극적으로 참여할 수 있도록 하 여야 한다. 그리고 DIP금융 제도 도입을 통해 기업회생을 위한 종자돈 을 채권자 또는 외부 투자자들이 공급할 수 있게 해줄 수 있다면 이를 통해 건전 한 기업이 대외적인 환경 변화로 인하여 일시적으로 유동성 위기에 직면하더라 도 빠른 시일 내에 극복할 수 있고 이것이야말로 진정한 기업회생제도라고 할 수 있 을 것이다.
