This research contends an epigraph of controversial issues in the process for legislation of GHG-ETS(Emissions Trading System). Supporting the said idea, this research was operated to recognize the trends of the UNFCCC(United Nations Framework Convention on Climate Change), understand the principle of ETS, grasp the situation of world market and examine the examples of legislations in the countries where the trading is carried out in order to derive the idea to pursue the legislations in Korea. The world’s Carbon market has been rapidly growing since 2005 forming a market value of $140billion in 2009. Thus the European Union and other advanced countries are putting much effort into prior occupation and Korea is also making progress in the legislation of ETS based on legal clauses of ETS which has its origin in ‘Basic Act on Low Carbon and Green Growth’. Legislation of ETS embarks on getting the root of legal character of ETS itself requiring to identify the character, span of the right and the limitation by making a new law to enable the law and the system to lead the market rather than discussing them in the established ways. Furthermore, setting the total amount of emission, guaranteeing the credits of distribution, and stabilizing the price of ETS are significant issues concerned with ETS system. Accordingly those two are the previous essential questions to make the ETS system effective in the end. Therefore constructing the accurate MRV system is necessary. It is also needed to promptly elect operators of the market. To be specific, we need to select an appropriate agent who is capable of global connection considering the trend of founding world markets and the cost required for it. Also we need to establish an organization for verification and registration due to the said MRV system beside the market. There has to be another institute for supervising the market as well. More over we need to resolve the problems and issues about legal restriction against ETS crime and speculation. Overall process for the legislation has to be proceeded regarding domestic situation and the connection of world market at the same time. This legal system mainly aims to reduce Carbon Emission and it has to play the crucial role of our reaction toward the climate change as we promote the legislation considering former legislation experiences of advanced countries. ETS should not just support ‘Green’ but lead to ‘Green-Growth’ directly.

본 연구는 우리나라 탄소배출권 거래제도의 입법에서의 쟁점들 에 대한 제언을 실시함을 그 내용으로 한다. 이를 위해 기후변화협상의 동향을 점검하는 한편 탄 소배출권 거래제도의 작동원리와 세계시장의 거래현황을 파악 하고 거래제도가 시 행중인 각국의 입법례를 검토하여 우리의 입법을 위한 시사점을 도출하였다. 세계탄소시장은 2005년 이래로 빠른 성장세를 보여, 2009년 기 준 약 1400억 달러의 규모의 거래시장을 형성하였다. 따라서 EU 등 선진국에 서는 세계탄소시장 의 선점을 위해 고군분투하는 모습을 보이고 있으며, 우리나라 도 올해 4월 저탄소 녹색성장기본법안에서 배출권 거래제도의 근거조항을 마련하여 , 현재 배출권 거래 제도의 입법이 진행 중에 있다. 배출권 거래제도 입법은 배출권의 법적성격을 규명하는 것에서 부터 출발한다. 배출권의 성격과 권리의 범위와 그 제한에 대한 내용을 기존의 틀에서 논의하기 보다는 새로운 입법을 통해 규명하여, 법과 제도가 거래시장을 이끌어나가야 할 것이다. 또 배출권과 관련하여 배출총량설정 및 배출권 할당대 상과 할당방법, 그 리고 배출권 가격안정의 문제가 중요한 이슈인데, 배출총량설정 과 배출권 할당의 신뢰성 확보는 배출권 거래제도의 성공을 위한 선결과제라 할 것이다. 이를 위해 정확한 MRV 시스템의 구축이 필요한 것으로 생각된다. 또 거래시장의 형성을 위해 거래소 운영 주체의 문제를 신속히 결정하여야 한다. 세계 거래소 설립 동향을 고려하여 국제적 연 계성와 비용효율적인 면에 가장 적합한 주체를 선정해야 할 것이다. 그리고 거래 조직과 관련하 여 거래소 뿐 아니 라 위의 MRV시스템과 관련하여 등록소 및 검증기관의 설립이 필요하며, 거래시 장 감독기구의 설립 또한 진행되어야 한다. 이밖에도 배출권 할 당을 둘러싼 법적 분쟁과 초과 배출 및 배출권 범죄와 투기에 대한 법적 제재 등의 이슈를 입법을 통해 해결해 나가야 한다. 이러한 국내적 상황의 고려 뿐 아니라 본 입법은 세계 시장과의 연계에 초점을 두고 진행되어야 할 것이다. 선진국들의 시행 경험과 선행 입법을 선례로 삼아 입법을 추진 하는 데에 있어 무 엇보다 중요한 것은 본 거래제도의 실시 목적이 탄소 배출의 감 축에 있으며, 그 제 도가 우리의 기후변화대응에의 중심적인 역할을 해야 한다는 것 이다. 탄소배출권 거 래제도는 “녹색”에서 그치는 것이 아닌 “녹색성장”을 이끄는 방 향이어야 할 것이다.
