The expansion of FTA is ineluctably attended with a high risk of illegal trade in the international market. Now it is time to analyze the present condition of illegal trade and to cope with it. So this study made use of minimization matrix of risk and cost in the border procedure as a analytical framework, and categorized illegal trades into customs, unfair trade, narcotic, social security and foreign exchange crime. Moreover, it made a general survey of illegal trades and analyzed the present status of categorized trade crime respectively. As a scheme for illegal trade response system in the perspective of new institutionalism and forced institution(law), it suggests an institutionalization model and governance conception which comprises issue identification, institutional design, institutional implementation, and feedback. To put it more concretely, the suggestion comprehends the accuracy of law and prescription, the limited integration of the border procedure bureaus in the phase of institutional design. What is more, it brings forward the building of comprehensive risk management system, the securing of specialized bureau, and the establishment of cooperative arrangements in the inspection agencies with the relevant, in the phase of institutional implementation as well.

본 연구는 FTA 시대 무역자유화과정에서 야기된 불법무역의 위험성 과 그 방지대책 요 구라는 문제를 제기하면서, 탈법위험의 억제를 위한 대응책을 모색해 보고자 하였다. 이에 따라 본 연구는 법제도 질서를 벗어난 불법무역 분석의 틀로서 국경 절차에서의 위험-비 용 최소화 매트릭스를 도입하고, 관세범죄와 부정무역범죄 둥 불법무 역의 주요 범주를 설 정하여 분석한 후에, 방지대책에서는 불법무역 대응체계 제도화의 기 본구상과 불법무역 대응의 주요 방향을 제시하였다. 또한 국경절차 유관기관 간 상호협 조가 대응체계의 제도 화에 영향을 미치는 가장 중요한 요인이라는 관점을 불법무역대응 거 버넌스라는 개념으 로 정리하였다. 불법무역 대응체계 제도화의 기본구상 아래 불법무역 에 대한 주요 방지대 책으로는 법규 정비 측면에서 정책규정과 집행규정 등 법규체계의 명 확화, 조직 정비 측 면에서 국경절차 관리기관의 제한적 통합성 추구, 전문조사조직 및 인력 확보를 제시하였 다. 또한 대응절차 측면에서 실효적 절차규정의 마련을 통한 각 기관 의 효율적인 정보시 스템 및 종합적 위험관리시스템 구축, 유관기관간 협력 측면에서는 기관간 정보시스템 연 계운용 및 정례적 업무교류, 민간 참여를 유도하기 위한 인센티브 제 도의 명문화 등을 제 시하였다. 본 연구의 불법무역 실태분석과 대책방안 모색을 계기로, 향후 FTA 확대에 따 른 경제적 효과의 기대에 병행하여, 무역자유화를 안착시킬 수 있는 불법무역 방지제도에 도 적절한 관심을 기울여야 할 것이다.
