The National Assembly is an organization that collects people’s opinions to resolve various and complex interests in a democratic, reasonable manner. Indeed, addressees of the law are confused because of overlapping laws; hence the need to eliminate duplications. This report seeks to discuss the consolidation of confusing lawsespecially those regarding national land planning－to make them consistent and efficient. The Framework Act on National Land, the National Land Planning and Utilization Act, and the Framework Act on the Regulation of Land Use are the main laws on land planning. The Framework Act on National Land and the National Land Planning and Utilization Act regulate land planning, whereas the National Land Planning and Utilization Act and the Framework Act on the Regulation of Land Use stipulate regulations on the use of land. Accordingly, the consolidation of these three laws may be the subject of discussion based on similarities among institutions and laws. This paper proposes the Act on National Land Planning, Etc. (tentative name) as the combined form of the Framework Act on National Land and the National Land Planning and Utilization Act and the Act on the Regulation of Land Use (tentative name), the merged form of the National Land Planning and Utilization Act and the Framework Act on the Regulation of Land Use.

국회는 국민들의 의견을 수렴하여 다양하고 복잡하게 얽힌 이해관계를 민주적이고 합리적으로 결정하는 기관이다. 국회에서 다수의 중복 법률 제정으로 인하여 수범자들은 많은 혼란을 겪고 있는 것도 현실이다. 이에 중복법률의 정비가 필요하다. 본 연구에서서 중복 법률의 해결을 위한 제안으로 법률 통폐합에 대한 논의를 하고자 한다. 그 중에서도 국토계획 관련 법률에 대해서 하고자 한다. 기본적으로 국토계획 법률은 국토기본법, 국토의 계획 및 이용에 관한 법률, 토지이용규제기본법이 있다. 국토기본법과 국토의 계획 및 이용에 관한 법률은 국토계획에 관한 내용을 가지고 있다. 국토의 계획 및 이용에 관한 법률과 토지이용규제기본법은 토지이용행위의 규제에 관한 내용을 가지고 있다. 따라서 위 법률들의 통폐합에 대한 논의를 할 수 있다. 그 중에서 기관의 유사성, 법률의 유사성에 의한 사유로 인하여 통폐합이 가능할 것이다. 이에 따라서 국토기본법과 국토의 계획 및 이용에 관한 법률의 통폐합 형태인 국토계획 등에 관한 법률(안), 국토의 계획 및 이용에 관한 법률과 토지이용규제기본법의 통폐합 형태인 토지이용규제에 관한 법률(안)을 제안하고자 한다.
