This study focuses on the independence of nomonating for local councils. By doing this, it will help nat only to strengthen the function assisting the local councils activities, but it will also increase their autonomy, efficiency and expertise. The systematic device should be equipped in order to operate local autonomy effectively through carrying out their own tasks of the local government and the local assembly. However, the local government has the right of personnel management over secretariat officials of local assembly. Therefore the staffs who are employed as an administrative officials are more attached to the local government than assembly. And, it is very difficult to have upright behavior because the government and assembly have a different position each other. As an alternative method to overcome these kinds of matter, the independence of the right of the local assembly has been come to the front. Accordingly, the study aims at suggesting the ways for securing the independence of the right through analyzing systemic conditions and contents on the personnel management of Local Assembly.

본 연구는 우리나라 지방의회 사무기구의 인사운영 제도를 개선하기 위한 방안을 논의한다. 먼저, 지방의회 사무기구의 인사운영에 관한 이론적 고찰과 선행연구를 검토해 본다. 지방의회 인사운영제도를 살펴보고, 이를 종합적으로 검토하고, 미국, 영국, 프랑스, 일본의 사례를 논의한다. 이와 같은 논의를 근거로 지방의회 사무기구의 인사운영 제도 개선방안을 모색한다. 먼저, 2009년 이후 국회 상정된 지방의회 사무기구 인사권 독립관련 법안들을 검토해 보고, 지방의회 사무기구의 인사권 독립방안을 사무처장 및 사무국장에 대한 인사권, 사무직원에 대한 인사권 그리고 전문직원 인사권 및 의회직렬 신설로 구분하여 복수의 방안들을 제시하였다. 복수의 방안들에 대한 선택은 그 지역의 정치적․문화적․사회적․전통적 환경 등에 따라 달라질 수 있다. 지방의회의 운영체제가 각 지역적 특성에 맞게 다양화될 수 있도록 방안을 선택하여 도입․실시하는 것이 필요하다. 요컨대, 지방의회 사무기구의 인사권 독립방안에 대한 선택을 통하여 지방의회가 행정기관에 대한 감시․감독 기능의 강화는 물론이거니와 지역사회의 거버넌스 주체로써 지역발전과 주민만족을 위한 역할을 다할 수 있도록 해야 한다.
