The Land Development project by Housing site Development promotion Act is consist of 3 parts of acquisition, development and supply. 택지개발촉진법에 의한 택지개발사업은 취득, 개발 및 공급의 절차로 이루어진다. 택지개발사업 기간은 사업의 규모에 따라 다르지만 토지 취득으로부터 약 5년 정도 소요된다. 토지소유권을 공시할 수 있는 등기부는 사업이 완료되고 지적확정 측량에 의하여 종전 지적공부가 전부 폐쇄되고 새로이 지적공부가 작성되어 있어야 하기 때문에 택지개발사업이 완료되기 이전에는 소유권을 공시할 수 있는 방법이 없다. 그러나 주택의 조기 공급을 위하여 택지개발사업이 완료되지 않은 상태에서 사업시행자가 주택건설업자에게 토지를 선 분양하는 것을 허용하고 있으므로 택지개발사업이 종료되기 전에 주택건설사업이 먼저 종료되는 사례가 발생되고 있다. 이로 인하여 아파트 또는 상가 수분양자는 재산권 행사의 제한으로 금융부담이 증가하는 등 많은 문제점을 야기하고 있다. 이의 해결 방안으로 국가가 인정하는 임시지적공시와 임시등기부제도를 운영하여 불완전한 지위에 있는 국민의 재산권을 보호할 수 있다.
