As conditions related to a reconstruction project of an aggregate building, the「Act on the Ownership and Management of Aggregate Buildings」regulates that it is carried out according to resolution of reconstruction, and the「Act on the Maintenance and Improvement of Urban Areas and Dwelling Conditions for Resident s」is regulating that the reconstruction project is promoted through agreement of union establishment by a union. These two Acts are different from each other in quorum conditions of resolution of reconstruction or agreement of union establishment, and moreover, are not coincident in opinions on whether the resolution of reconstruction according to the「Act on the Ownership and Management of Aggregate Buildings」in the reconstruction project of the「Act on the Maintenance and Improvement of Urban Areas and Dwelling Conditions for Resident s」, so that it is providing confusion on execution of reconstruction. The present thesis criticizes a useless theory of resolution of reconstruction by theories and leading cases on whether the resolution of reconstruction according to the procedure of the「Act on the Ownership and Management of Aggregate Buildings」in the reconstruction project of the「Act on the Maintenance and Improvement of Urban Areas and Dwelling Conditions for Resident s」, and suggested its basis of an argument in a standpoint of a useful theory.

집합건물 재건축사업과 관련한 요건으로서「집합건물법」에서는 재건축결의에 의하도록 규정하고,「도시정비법」에서는 조합설립동의를 거쳐 조합에 하여 재건축사업을 진행하도록 규정하고 있다. 이 두 법률은 재건축결의 또는 조합설립동의의 정족수요건이 서로 상이할 뿐만 아니라, 더욱「도시정비법」상 재건축사업에「집합건물법」의 절차에 의한 재건축결의를 거쳐야 하는가에 대하여 견해가 일
치하지 아니함으로써 재건축의 실행에 혼선을 주고 있다. 이 논문에서는「도시정비법」상의 재건축사업에도「집합건물법」상절차에 의한 재건축결의가 있어야 하는가에 대한 학설과 판례를 분석하여 재건축결의 무용론을 비판하고, 유용론의 입장에서 그 논거를 제시하였다.
