The civil law and the real-estate registration law were newly e nforced on January 1, 1960 and have been in force. But the people s had made an application for the real-estate registration. So, the government has enacted various special acts(The Act on Special Measures for Registration, etc. of Transfer of Real Estates Owner ship, Registration of Real Estate Act, Act on Special Measures for the Registration of Real Estate, Act on the Registration of Real E state under Actual Titleholder′s Name and so on) to solve these problems. However, it is still in existence that is real-estate regis tration non-corresponding to the substance. In this study, I would review and analyze some problems of v arious special acts(The Act on Special Measures for Registration, etc. of Transfer of Real Estates Ownership, Registration of Real Estate Act, Act on Special Measures for the Registration of Real Estate, Act on the Registration of Real Estate under Actual Titlehol der′s Name and so on). This discussion would furnish the first step toward the solution of the question to improve the real-estat e registration system.

우리나라는 1960년 1월 1일 민법 및 부동산등기법이 새로 시행된 이래 현재에 이르기까지 다양한 부동산등기와 관련하여 다양한 특별법을 제정하여 시행해 왔다. 이러한 특별법들은 물권의 득실변경에 대하여 등기가 제대로 이루어지는 않는 문제점을 해결하기 위하여 국민들의 등기신청을 유도하는 등 부동산의 현황 및 권리관계에 관한 실제를 부동산등기부와 일치시키기는 것을 목적으로 제정된 것이다. 그러나 이러한 법률의 제정 등을 통한 노력에도 불구하고 여전히 부동산의 현황 및 권리관계에 관한 실제와 부동산등기부가 일치 하지 않는 부실등기의 문제가 여전히 발생하고 있다. 실제로 2005년 10월 2일 재정경제부(현 기획재정부)가 국회 재정경제위원회에 제출한 국감 자료에 따르면 2005년 8월말 현재 일제 강점이 이후 소유자를 찾지 못해 일본인 또는 일본법인 명의로 남아 있는 땅이 37,178필지, 54,930,000㎡(1661만평)에 달하는 것으로 조사되었으며, 주인 없는 땅인 무주부동산도 2005년 8월말 현재 19,848필
지, 77,710,000㎡(2350만평)에 달하는 것으로 조사되었다. 이에 본 논문에서는 이러한 특별조치법이 어떠한 취지와 내용으로 시행이 되었고, 그 문제점은 무엇이었는지에 대해 고찰하여 향후 우리나라 부동산등기제도 개선의 단초를 제시하고자 한다.
