Although the Sentencing Committee developed the sentencing guideline for eight seven of crime in Korea, there are still disagreement the validity of the guideline among scholars and lawyers. Also, there is no research to evaluate the validity of the sentencing guidelines for bribery offenders. The purpose of this study is to analyze the status quo of the application of the first Korean sentencing guidelines for bribery offenders. As reviewing the departure rate, we explored how prosecutors and judges have different decision for the same. Also, we examined the validity and reliability of the guideline for the bribery crime. The data were obtained from the Prosecutorial Guideline System (PGS) of the Supreme Prosecutors' Office, Republic of Korea. Based on the PGS data archive, we finally selected 128 available population cases of the bribery offenses which were sentenced from July 1, 2009 to September 30, 2010. To describe the type of crime, we mainly used descriptive statistics and t-test. In addition, the VIF test, and OLS regressions were used to evaluate the appropriateness of the sentencing factors of bribery model in the sentencing guidelines. The results show the frequency of the each sentencing factors, type of the decision, length of the sentencing factor, and viability of the factors, and additional significant factors for the bribery cases. Detailed findings and policy implications will be discussed in the context.

본 연구는 2009년부터 적용되기 시작한 제1기 양형기준 중, 뇌물수수 범죄행위에 대한 양형기준의 적용현황을 분석하고 그 기준의 적절성을 평가하는 것을 주요 목적으로 한다. 더불어, 현재 뇌물수수죄 양형에서 고려되는 사항과 이들의 처벌수준에 대한 대략적인 정보를 파악하고자 한다. 뿐만 아니라, 검사에 의해 입력된 양형인자와 판사의 최종선고형량의 구간의 위치를 살펴봄으로써 두 형사사법기관이 가진 동일한 사건에 대한 상이한 시각의 정도도 파악할 수 있다. 또한 뇌물수수 양형인자의 적절성 평가를 실시함으로써, 양형차이를 유발하는 인자들의 상대적 영향력과 전체 뇌물수수 모형의 설명력을 제시하도록 한다. 이를 위하여, 본 연구는 2009년 7월 1일부터 2010년 9월 30일까지 공소 제기된 뇌물수수사건 중 1심 판결에서 실형을 선고받은 사건 전체를 모집단으로 분석하였다. 양형기준의 적용현황을 제시하기 위해서는 전반적으로 기술통계가 사용되었고, 모형의 적설성 평가에는 t-test, 다중공선성 분석, 그리고 회귀분석이 중점적으로 사용되었다. 분석결과에 따르면 뇌물수수 양형인자들 중 빈번하게 인정되는 인자들은 가중요소에 집중되어 있는 경향이 있으며, 구체적으로 “업무관련성이 높은 경우,” “적극적 요구,” “진지한 반성”이 가장 빈도수가 높았다. 회귀분석결과, 양형인자들의 모형자체가 적합하지 않아 인자들의 유의미성도 논할 수가 없으며, 전반적으로 뇌물수수 양형모형 자체의 수정이 요구되었다.
