The purpose of this article seeks to examine the roles, considerations and implications of Rules of engagement(ROE) from the case studies in U.S. and ROK. Rules of engagement are written to provide guidance to military commanders in the field on military actions in peacetime, crises and wartime. Two general categories of ROE exist. First, ‘delegated control’ which imposes permissive ROE broadens decision-making authority of the on-scene commander. It is more appropriate for an environment marked by uncertainty and ambiguity. However, ‘positive direct control’ that imposes restrictive ROE narrows his decision-making authority. It is more appropriate for standard situations that are easily anticipated. Considering the natures of surprise and uncertainty during crises, the use of ROE to respond changing crisis situations is highly sensitive issues. Underreaction results in expansion of damages and overreaction brings about expansion of escalation. In the use of ROE for crisis management which related to scopes and levels of military forces, tensions exist between the political/diplomatic and military considerations that creates a dilemma to adjust two considerations. Thus, although the perfect set of ROE exists, ROE should be tailored to a particular crisis. Political leaders should control ROE to fit their crisis management objectives.

이 논문의 목적은 위기관리를 위한 교전규칙의 역할과 고려사항 및 시사점을 사례연구를 통해 살펴보는데 있다. 교전규칙은 군 지휘관에게 평시와 전시에 군사력 사용에 대한 지침을 사전에 제공한 것이다. 위기시 적용되는 두 가지 교전규칙 유형으로 우선 ‘위임통제’는 관대한 교전규칙의 특성을 가지고 있으며 현장지휘관의 결정권한을 확대한 것으로, 불확실하거나 모호한 상황에서 위기발생을 예상하기 힘든 경우에 적합하다. 반면 ‘직접통제’는 제한적인 교전규칙의 성격을 띠며 현장지휘관의 전술적인 결정권한을 제한한 것으로, 일반적으로 위기상황이 쉽게 예상되는 경우에 적합하다. 기습적이고 불확실한 위기의 속성을 감안한다면, 위기시 변화하는 상황에 대응하기위해 사전에 규정된 교전규칙은 과소대응으로 인한 피해확대와 과대대응으로 인한 위기확대를 초래할 수 있는 상당히 민감한 사항이다. 즉 군사력 사용 범위와 수준과 연관된 교전규칙은 위기관리를 위한 정치·외교적 고려사항과 군사적 고려사항간의 갈등을 초래할 수 있는 문제이기에, 두 가지 고려사항에 적절히 부합해야 하는 딜레마를 항상 내포하고 있다. 따라서 아무리 완벽하게 작성된 교전규칙이 있더라도 특정 위기에 적합한 교전규칙의 운용이 중요하고, 이를 위해서는 국가지도부의 위기관리 목표에 부합될 수 있는 효과적인 정치적 통제가 필요하다.
