The performance of construction safety management depends upon the level of client involvement. In order to significantly reduce construction injuries, the role of clients have to be reshaped and positioned at the top of safety organizations. CDM(Construction Design and Management Regulations 1994, UK) was first launched client-initiative legislations and this was introduced as an to-be model of construction safety organizations in Republic of Korea. However, current safety legislations has no sound foundation for client involvement because of insufficient understanding for the core concept and built-in mechanisms of CDM. This study aimed to support shifting current contractor-imposed regulations to client-initiative one through the indepth analysis of the built-in critical elements of CDM. According to the analysis, the core mechanisms which enabled CDM effective are articulated safety role of client, ensured safety enforcing competency by the client nomination of safety coordinators, and capturing easy access route to the mobile and temporary construction sites through site notification forms. In conclusion, the critical mechanism of CDM is the responsibility of designer and contractor to inform their client of the legal responsibility stipulated in CDM. This function makes clients recognize their legal responsibility and all stakeholders collaborate together within every single project.

건설재해의 효과적 예방을 위해서는 건설산업에 유효한 안전관리체제의 구축이 선결과제이나, 우리나라의 안전관리체제는 발주자가 제외된 시공자 중심의 체제로서 안전활동의 실효성에 근원적 한계를 가지고 있다. 본 연구에서는 발주자 주도 안전관리체제의 모범이 되는 영국의 CDM제도에 내재된 발주자 주도의 메카니즘을 분석하여 제시함으로써, 발주자 주도의 안전관리체제 구현을 통한 건설재해의 효과적 저감에 기여하고자 하였다. 연구 결과 CDM 제도의 핵심 메카니즘은 발주자를 비롯한 이해 당사자의 포괄적이면서도 명확한 안전책무의 천명, 안전전문가로서 SC(safety coordinator)의 역할과 선임 방식을 통한 발주자의 안전 역량 보완, 공사 통지제도를 통한 한시적 유동적 공사현장 접근 경로의 확보 등으로 나타났다. 이러한 안전관리체제의 구현을 위해서는 기존의 산업안전보건법령과는 독립된 법령이 제정이 필요하며, 이로써 공사 참여자의 협력을 통한 건설재해의 획기적 저감을 달성할 수 있을 것으로 기대된다.
