The necessity of unification of the economic systems is raised as the need for the establishment of cooperative relations of the East Asian economy has been increased. It is institutionally needed to enlarge the understanding of the mutual systems through comparison and examination of the area of economic-related laws. It has a very important meaning to make orderly marketing function properly via secure the free and fair competition in the world market in the global economic system of New Liberalism. The competition policy of every country has been strengthened and standardized gradually. Especially the tie-up has become the generalized phenomenon around the world. The restraints on competition caused by the tie-up is recognize as an important problem and regulated by authorities in each country. And each country expand the application of the competition law to foreign companies as well as domestic companies - what is called extraterritoriality. In this situation it is meaningful to compare and examine the experience of Japan which enforced the competition policy before us.

동아시아경제권의 협력관계구축의 필요성이 증가함에 따라 경제관련 제도의 통일의 필요성이 제기되고 있다. 제도적으로는 경제관련법 영역에 대한 비교․검토를 통한 상호제도에 대한 이해를 확대하는 것이 요구된다. 신자유주의를 중심으로 하는 세계경제체제에서 세계시장질서에서의 자유롭고 공정한 경쟁의 확보를 통해 시장질서가 제기능을 발휘하도록 하는 것은 매우 중요한 의미를 가지며, 각국의 경쟁정책은 점차 강화되고 통일화되어 가는 현상이 나타나고 있다. 특히 기업간의 결합은 전세계적으로 일반화되어 있는 현상으로서 기업결합으로 인한 경쟁제한은 각국에서 중요한 문제로 인식되어 규제가 이루어지고 있다. 또한 각국은 경쟁법의 적용범위를 국내가 아닌 외국기업에 대해서도 확대하는 이른바 역외적용이 이루어지고 있다. 이러한 상황에서 우리보다 앞서 경쟁정책을 실시해온 일본의 경험을 비교․검토하는 것은 의미가 있다고 하겠다.
