In the criminal procedure in the U.S., police enjoys a meaningful status and exercises a significant amount of power from investigation through trial. As the initial criminal investigator, police exercises an independent investigative power and further shows a practical authority during the charging process for misdemeanor.
With respect to felony, although prosecutor exercises charging power with a more important and final authority, police as an initial investigator also lays a substantial foundation by seeking legal advice from prosecutor. Police is also involved in plea bargain as an advisory opinion provider when charges are dismissed. During the trial, police introduces evidence by testifying under the direct evidence rule in the U.S. trial system and thus perform a critical function. Finally, police indirectly affects sentence by showing aggravating or mitigating factor.
