In this article I wanted to explain a theoretical foundation and a structural method of the codes of the correctional ethics for the Korean correctional system. I have been used to think that confinement or incarceration could not be the real aim of correction, and that the genuine role of correction would be finished as the prison inmates would be saftly and normally returned to their original society. For it the correctional ethics must be re-considered, and the codes of the correctional ethics will be the most important part of correction and enable it to fulfill the correctional mission successfully. I defined the field of correctional ethics as all human relation of the prison officer and inmates. Then I gathered different items and constructed a detailed ethical codes forming human and ethical relations. for my arguments I wanted to say as follows. First, mentioning the autonomy and duty of a prison officer I compare and analyze the meaningful connection of the prison expertise and ethical identity. Second, I criticize the existing ethical codes of the public service personnel as well as the ethical codes of correction of the U.S.A.., soon after why we need the condition of the necessities and items of the ethical codes. Third, I prepare the conditions of different codes in the practical level but on a draft plan. As a result, I, in this article, urged the concern of the construction of ethical codes from the Korean Prison Service, and the serious need of study and research. Then I proposed a ‘Koreanized Ethical Codes of Correction’ in which the codes will be matched and performed well. lastly, by the construction of the ethical codes of correction I wanted to confirm a rational and sound correction system in Korea, and further mention the social and public benefit of the codes.

이 글에서는 국내 교정윤리강령의 의의와 이론적 근거, 그리고 체제 방식에 대해 논의하고자 한다. 논자는 재소자를 단순히 수용하는 것으로 교도소의 역할을 다했다고 할 수 없고, 그들이 안전하게 사회에 복귀하도록 도와주고 살펴주는 것이야말로 교정의 진정한 역할이며 완성이라고 생각하고 있다. 이를 위해 교정윤리에 대한 재고가 있어야 하며 윤리강령은 주요한 이러한 교정의 완성을 위한 한 축을 담당한다고 본다. 이를 위해 교정윤리를 교도관과 재소자 사이의 인간적이고 윤리적 관계를 모두 함의하는 것으로 규정했다. 그리고 그들 사이의 인간적이고 윤리적 관계를 이상을 다양한 형태의 윤리강령의 항목으로 구성하고자 했다. 이 글은 다음과 같은 순서로 진행한다. 첫째, 교도관의 자율성과 책임을 논의하면서 교정의 전문성과 윤리성의 발달 관련을 비교 분석한다. 둘째, 교정윤리 강령의 항목조건과 필요조건을 논의한 뒤, 국내의 유사한 윤리강령과 미국의 교정윤리 강령을 평가한다. 셋째, 교정윤리 강령의 실제적인 항목의 근거를 시안 수준에서 마련하고자 한다. 결론적으로 윤리강령에 대한 교정본부의 관심을 촉구했으며, 본격적인 한국적 교정윤리 강령을 마련하기 위한 조사연구가 이루어져야 함을 주장했다. 그리고 강령을 만듦에 있어 국내 실정에 맞는 ‘한국적 교정’의 필요성을 언급했고 몇 가지 제안을 제시했다. 마지막으로 제대로 된 교정윤리 강령의 제작을 통해 교정의 합리화와 건전성을 확보하고, 사회적 공익에도 이바지할 수 있음을 설명하고자 했다.
