From 2008 to August, 2010, the number of corrupt and disqualified police officers was revealed to be 2,785. Combining the unexposed corrupt or disqualified police officers, it can be predicted that considerable number of officers have committed actions that are unqualified for a police officer. Unqualified action generally differs from the notion of corruption. Unlike the existing notion of corruption, which only concentrates on illegal acts, disqualifying action is a wider concept that expands its range to the private lives of public officials and considers public officials failing to serve as a model disqualifying. Within such disqualifying acts, the disqualifying acts of police officers differ from those of general public officials due to the distinct characteristics of police. Disqualifying actions committed by police officers cause serious problems especially because the police have governmental authority. Currently, the police categorizes disqualifying actions into take in the money and goods, unfair treatment, neglect of duty, damage to dignity, violation of rules. However, the categorization varies among different scholars. In order to solve these problems, education on police ethics, improvement of noxious environment, reinforced surveillance and improved working conditions have been suggested. For better police ethics education, the Police Training Institution is implementing “self-development courses,” which is expected to prevent the occurrence and recurrence of disqualifying acts as well as to alert police officers. “self-development courses” strengthened ethics education by practical introduction of the methods that failed in ethics education through existing refresher and extension course such as feedback. It also improved the ethics education by measuring the effectiveness of the program, and guaranteed the effectiveness of education by public service for disabled and participation-based learning. This study therefore examined ethics education via refresher and extension course over existing methods such as “Corrupt System Improvement” and “Enhancement the work of prosecutors” as a means to effectively manage corruption and disqualifying acts and to increase the credibility of the police from people.

2008년부터 2010년 8월까지 집계된 경찰부패 및 부적격자 적발 인원수는 2,785명으로 상당히 많은 인원이 적발되었다. 실제 적발되지 않은 부패자 및 부적격자의 수를 합친다면 상당히 많은 인원이 경찰관으로서 부적격행위를 하였다고 예상할 수 있다. 일반적으로 부적격 행위는 부패의 개념과 차이가 있다고 볼 수 있다. 부적격 행위의 경우 부패 보다 더 넓은 개념으로서 기존의 부패에 대한 개념이 법률을 위반한 행위에 목적을 둔것과 달리 부적격 행위는 공직자의 사생활까지도 범위를 넓혀 모범을 보여야 함에도 불구하고 그러지 못한 행위를 한 것 까지 부적격 행위로 간주하였다. 이러한 부적격행위 중 경찰의 부적격행위는 경찰이 가지는 특수성 등에 의해 일반 공직자 부 적격행위와 차이점을 두고 있다. 특히, 공권력을 가지는 권력기관이기 때문에 경찰이 저지르는 부 적격행위는 심각한 문제를 양산하고 있다. 현재 경찰에서는 부적격행위로는 금품수수, 부당처리, 직무태만, 품위손상, 규율위반으로 분류 하고 있다. 그러나 이러한 부적격행위를 학자별로 다양하게 분류하고 있다. 이러한 문제점을 해결하기 위하여, 경찰의 윤리교육강화ㆍ경찰의 유해환경개선 및 감시의 강화 ㆍ근무여건개선 등과 같은 방안을 제시하고 있다. 이중 경찰의 윤리교육 강화를 위해 재직자 교 육과정을 통해 부적격행위를 한 경찰관에게 재발을 방지하고, 부적격행위를 예방하며, 주변 경 찰 관들에게 부적격행위에 대한 위하효과를 기대할 수 있는 ‘자기개발향상과정’을 경찰교육원에서 실 시하고 있다. ‘자기개발향상과정’은 기존의 재직자교육과정을 통한 윤리교육에서 실패하였던 환류 등의 방법 을 실질적으로 도입하여 윤리교육이 강화되었으며, 효과성까지 측정하여 교육에 대한 문제점을 개선하였으며, 장애인 봉사활동 및 참여식 교육을 통해 효과적인 교육이 진행되도록 하였다. 따라서, 이 논문에서는 지속적으로 발생하고 있는 경찰부패 및 부적격행위에 대해 효과적으로 대처하여 일반 국민들에게 경찰의 신뢰도를 향상 시킬 수 있는 방법으로서 기존의 부패제도개선 , 감찰기능강화와 같은 방법에서 벗어나, 재직자 교육방법을 통한 부적격행위자에 대한 윤리교육 에 대해서 살펴보았다.
