The increasing use of the Internet plays an important role to guarantee such liberties a sthe right-to-know of freedom of expression. However, his also leads to social side-effects through the circulation of illegal and detrimental information by adolescents in the cyber-world. Therefore an appropriate measure is required due to the fact this situation is harmful to the development of adolescent emotion. This thesis about legitimacy and effectiveness of the media regulations protecting children and adolescents is required as media environment changes rapidly. However, discussion about adolescent protection and broadcasting policies in the fast paced media environment has not taken place enough in Korea. Internet is to be regulated based on its contents for protecting minors from explosure to illegal and harmful materials to youth. This study suggests the direction for the representative adolescent protecting policies. For examples programming for indecent programming, and program ratings through an empirical analysis of the groups of experts, parents, children and adolescents.

21세기 컴퓨터와 인터넷을 통한 정보환경의 급격한 변화는 사 회 구성원의 정보에 대한 접근 가능성을 증대시켰다. 범정부적인 차원에서도 전자정부라는 기조아래 정보통신기반의 확충으로 인 하여 정보화 사회는 급속히 진전되었다. 그러나 방송과 통신의 융합환경하에서 외국문화의 손쉬운 유입 에 따른 문화 정체성의 위기, 정보의 격차, 컴퓨터 관련 범죄 증 가, 불건전 정보의 유통 심화, 정보통신을 매개로 한 간접적인 인 간관계의 증대로 인한 인간소외 현상 및 윤리적 감정의 결핍으로 인한 비도덕화 등으로 인한 병폐가 생겨나고 있다. 이를 종합해 보면 사회 전체에 대한 부조리의 증대라고 할 수 있다. 이 중에서 가장 큰 문제라고 할 수 있는 것은 어린이와 청소년에 대한 무분 별한 정보제공 및 불건전 정보의 유통, 정보통신을 매개로 한 범 죄의 증가 등을 들 수 있다. 이러한 문제들을 해결하고 청소년을 보호하기 위한 다수의 입법들이 나타나고 있다. 그중에서 청소년 보호의 주축을 이루는 법률로 ｢청소년보호법｣, ｢방송법｣을 들 수 있다. 이 법은 청소년에게 유해한 매체물과 약물 등이 유통되는 것과 청소년이 유해한 업소에 출입하는 것 등을 규제하고, 청소년을 청소년 폭력 , 학대 등 청소년 유해행위를 포함한 각종 유해한 환경으로부터 보호, 구제함으로써 청소년이 건전한 인격체로 성장 할 수 있도록 함을 목적으로 제정되었다. 이에 대해서 첫째, 미디어 환경 변화에도 불구하고 어린이ㆍ청 소년 보호를 위한 방송규제의 필요성이 인정되는 만큼 규제기관 은 어린이ㆍ청소년 보호 방송규제의 원칙을 수립할 필요가 있다. 둘째, 사업자 자율규제를 도입에 대한 법조항의 정비이다. 사업 자 자율규제의 경우 방송법 제86조와 같이 법적으로 사업자에게 자율규제를 명령할 수도 있다. 셋째, 지상파방송에서 어린이ㆍ청 소년 프로그램 의무편성 제도 도입 가능성을 검토해 볼 필요가 있다.
