Although the study of the indirect discrimination through defendant's socioeconomic factors is a very important subject, it has received less attention. The purpose of this study is to examine the effect of defendant's socioeconomic status on the type of attorney and an agreement and then, analyze the effect of the type of attorney and an agreement on prosecutors' sentencing recommendation and judges' decision for sentence length. The study showed that defendant's socioeconomic status has strong impact on the type of attorney rather than an agreement. However, the study found that an agreement has consistently strong effect on sentencing outcomes. Finally, the study suggested that defendant's socioeconomic status has an impact on sentencing outcomes through the type of attorney and agreement both.

공판과정에서 피의자의 사회적, 경제적 요인의 간접적인 차별 연구는 그 중요성에도 불구하고 적절한 주목을 받지 못했다. 본 연구의 목표는 피의자의 사회적 경제적 요소들 이 변호인의 종류 그리고 합의 도출 여부에 어떤 영향력을 끼치는가에 대해서 분석하고, 다시 변호인의 종류와 합의 도출여부가 검사의 구형량과 판사의 선고형량에 어떻게 영향 을 끼칠 것인가에 대해서 분석하기 위함이다. 연구의 결과는 피의자의 사회적 경제적 요 인들은 합의 도출보다는 변호인의 종류에 더 많은 영향력을 가지고 있는 것으로 나타났 다. 하지만, 재판의 결과에는 합의도출이 일관적이고 강한 영향력을 미치고 있음이 발견 되었다. 마지막으로 연구는 피의자의 사회적 경제적 요인들이 사선변호인 그리고 합의 모두를 통해 간접적으로 재판의 결과에 영향을 끼치고 있음을 나타내고 있다.
