The recent developments in information and communication technology and the use in education are facing various issues related to copyright. The copyright law does not quickly reflect the characteristics of changing rapidly digital media. Thus the law faces new issues in education field. In the paper, the following issues are considered: The use of copyrighted works without obtaining permission from the copyright owner; the different interpretation of “lesson and support” in the copyright law of Korea; the responsibility of the use in copyrighted works; the range of the meaning for the term textbooks for the subject matter in the law; the application of the fair use doctrine; and the raise of some issues regarding the moral rights of the copyright owner.

정보통신기술의 발달과 이의 교육적 활용은 저작권과 관련한 여러 가지 문제에 직면하게 되었다. 서책 중심 의 저작권법은 빠르게 변화하는 디지털 매체의 특성을 따라가지 못함으로써 교육에서 새로운 문제와 직면하게 되었다. 교과서에 공표된 저작물의 임의 게제, 저작권법의 ‘수업 및 지원’의 해석 차이, 저 작물 이용 주체의 문제, 교과용 도서에 전자저작물의 포함 여부, 시험문제의 공중 송신 허용 여부, 복제 방지 조치 의 주체, 포괄적 공정 이용 제도 도입, 저작인격권의 존중과 관련한 문제를 제기하고 해결방안을 제안하였다.
