This thesis discuss 9.11 terrorist attack as the center on international treaties related with the international right of self-defense and international treaties on the aerial anti-terror and lay out preventive measures on the aviation terror and development ways. Terror sets out non-recognition on political and religious differences between people and nations. These aspects of terror are developing from man to man to group to nation. Some scholars are arguing that 9.11 terrorist attack has developed into extreme acts such as war not just a single terrorist action. This will be just the prelude to upcoming war. Not long ago Osama bin Laden was shot dead by American special force in Pakistan. US has chased silently on Osama bin Laden for the last 10 years ever since 9.11 terrorist attack. US has approached gradually to the shadow of Osama bin Laden with the exorbitant budget and manpower. Now the ball has crossed to the court of Al-Qaeda which lost it's leader, Osama bin Laden. Now nobody knows when, Where and How second 9.11 terrorist attack might happen. US has analysed everything what went wrong since 9.11 terrorist attack. US established a giant such as DHS(Department of Homeland Security) after realizing that 9.11 terrorist attack was due to the failure of intelligence network between national intelligence agencies. And pushed through the anti-terror act which was a highly controversial issue in Congress due to civil rights violation possibility and modified various laws and regulations on terror and installed FULL-BODY scanners which was also the center of civil rights violation at airports. The reinforcement measures at airports were backed by international treaties such as Tokyo Agreement, the Hague Convention, Montreal Protocol which aims to prevent aviation terror. If second 9.11 terrorist attack were to happen, more tightened up regulations would be enacted and more anti-equipment would be introduced. The aircraft terror causes enormous loss of lives and economic damages. I suggested various preventive measures to prevent aviation terror systematically such as activity through international organization(UN) and sanction through international aviation related NGO and hold terrorist and terrorist organization criminal and civil charges. There is no exception in Korea. We should pass anti-terror act which is pending in national assembly to protect national security. Also, If reinforcement of surveillance system such as CCTV and invigoration of counter-terror committee were not implemented in a short time, we could experience second 9.11 terrorist attack in Korea penitently as the proverb says "To lock the stable door after the horse is stolen". To root out terror on this planet for the safety of mankind is everlasting assignment to us who has counter terror related profession.

본 논문은 2001년 9월 발생한 뉴욕테러(이하 ‘9.11테러’라 한다.)를 중심으로 국제사회의 자위권과 항공테러방지와 관련된 국제협약을 살펴보고, 항공테 러 방지대책과 발전방향을 제시하는 것이 목적이다. 테러는 민족과 국가간 정 치적,종교적 차이를 인정하지 않는다는 것에서 출발한다.이와 같은 테러의 양 상은 개인대 개인에서,집단 대 국가로까지 발전하고 있다. 일부 전문학자들은 9.11사건은 ‘테러’가 아닌 ‘전쟁’이란 극단적인 행위로까지 발전되었다고 주장 하고 있다. 이것은 앞으로 벌어질 전쟁의 서막단계에 불과할 것이다. 얼마 전 ‘오사마 빈 라덴’이 미국의 특수부대(네이비 실1))에 의해 파키스탄에서 사살되었다.9.11테 러가 일어난 지 10년 동안을 미국은 침묵의 추격을 벌여왔다. 엄청난 예산과 인 력을 투입하며 소리 없이 조금씩 조금씩 빈라덴의 그림자를 향해 다가갔던 것이 다.이제 공은 또 다시 오사마를 잃은 알 카에다 측으로 넘어갔다.제2의 9.11테 러사건이 언제, 어디서, 어떤 식으로 일어날지는 아무도 모르는 것이다. 9.11테 러 후 미국은 무엇부터 잘못 되었는지를 하나하나 분석하여 왔다고 알려진다. 정보 네트웍이 제대로 작동 되지 않았다는 것을 먼저 깨닫고 각 정보기관을 통 제하고 정보공유를 할 구심점 역할의 국토안보부(Department of Homeland Security)란 거대조직을 탄생시켰다. 그리고 인권침해의 소지로 미국 의회에서 가장 통과시키기 꺼려했던 ‘반테러법’을 연이어 통과시키는 등 테러 관련 각종 법령을 정비하였고,공항에서 또한 끊이지 않는 인권침해의 산물인X-ray 알몸 투시기를 대량으로 도입하여 공항마다 설치하였다. 이 조치의 이면에는 예전부 터 항공기 테러와 관련 국제적으로 피해를 입은 각 국가들의 협약인 도쿄협약, 헤이그협약, 몬트리올협약 등이 법적으로 뒷받침되고 든든한 배경이 되어 주었 단 것이다. 또 다시 제2의 9.11테러가 일어난다면 더 보강된 법령과 반테러 장 비들이 제정되고,보강될 것이다.이 항공기 테러는 엄청난 인명 손실과 경제적 손실을 가져온다.이 항공테러를 시스템적,체계적으로 대응하기 위하여, UN 등 국제기구를 통한 예방활동,국제 민간항공기구를 통한 제재,테러범 및 그 단체 에 대한 형사책임뿐만 아니라 민사책임까지도 묻게 하는 방안을 제시하였다. 우리나라도 예외가 될 순 없다.현재 국회에서 계류 중인 테러방지법(가칭)을 신속히 통과시켜 국민의 안전을 보장할 법규가 시급히 정비되어야 한다. 또한 CCTV 등 감시체계의 강화, 대테러 대책위원회 활성화, 위기관리 매뉴얼의 보강 등을 시급히 하지 않으면, 미국의 9.11테러처럼 ‘사후 약방문’이 될 것이다. 무고한 민간인을 볼모로 잡고 희생시키는 테러리즘을 지구상에서 완전히 뿌리 뽑는 것은 현 시대를 살아가는 테러관련 모든 종사자들에게는 영원한 숙제이자 절실한 명제이다.
