This study analyzed the current situation of industrial espionage who disclose high-tech industrial technology which is the competitiveness of a company or country. It also attempted to draw out effective ways of improvement by understanding the problems of current policies. The number of industrial spies is constantly increasing every year. In 2004, there were 26 cases but in 2010, it increased to 41 which shows a rapid growth. In the industrial technology disclosure, electric/electronic and information technology area including semi-conductor technology for which Korea shows a strong competitiveness occupied 60%. Such disclosure was made by mostly former or current employees who occupied 77% of the total. As to the problems of the policies dealing with industrial spies, there are very few laws related to it and the government agencies did not fully cooperate. There is insufficient awareness of security on industrial technology and security education. Also, we are lack of international cooperative system. In order to make improvement, first, reorganization of the related law is necessary to increase the level of punishment and there must be a law that can prevent additional disclosure in the course of law suit. Second, government agencies or centers must be established to adjust or integrate the works done by many different agencies currently dealing with industrial spies. Third, in order to strengthen the education for the protection of industrial technology, cooperation from private sector is very much required. In particular, those possessing industrial technology must increase the level of security. Finally, cooperation between the countries is insufficient now due to their circumstances and cultural difference. Such problem must be improved and the international cooperative system must be solidly established.

이 연구에서는 기업이나 국가의 경쟁력이 되는 첨단 산업기술을 유출하는 산업스파이 범죄에 대하여 그 실태를 분석하고, 이에 대한 대응정책의 문제점을 파악하여 효율적인 개선방안을 도출하고자 하였다. 산업스파이 범죄는 매년 꾸준히 증가하여 2004년 26건이던 산업스파이 범죄가 2010년 41건으로 매우 급격한 증가 추세를 보이고 있다. 특징적인 부분은 산업기술 유출분야에 있어 세계적으로 강한 경쟁력을 보이는 반도체 기술을 포함한 전기전자 및 정보통신 분야가 60%를 차지할 정도로 매우 심각한 수준이었다. 또한 유출 주체에 있어서는 전․현직 직원의 경우가 77%를 차지할 정도로 매우 높은 비율을 차지하였다. 산업스파이 범죄에 대응하는 정책의 문제점으로 관련법규의 미비, 이에 대응하는 정부 기관간의 공조 미흡, 산업기술 보안의식의 결여와 보안교육의 부족, 국제공조체제의 미비점을 지적하였다. 따라서 개선방안으로는 첫째로 관련법규의 정비로써 현실에 맞게 처벌 수위를 높이고, 소송과정에서 산업기술의 추가유출을 방지할 수 있는 법규를 정비하여야 하며, 둘째로 산업스파이 범죄에 대응하는 다수 국가기관의 업무를 조정 내지 통합할 수 있는 기관이나 센터를 구축하여야 한다는 점을 들었다. 셋째로 산업기술 보호에 대한 교육을 강화하기 위하여 민관의 협력이 절실하며, 특히 산업기술 보유주체의 보호기능이 강화되어야 한다는 점과 마지막으로 각 나라의 사정 및 문화적 특징으로 인한 국제공조의 미흡한 점을 개선하여 국제공조체제를 공고히 하여야 한다고 주장하였다.
