This study aims at suggesting the ways that students human rights('SHR') would be developed to a systematic discourse by analysing the current issues on SHR. For this, one main question is asked whether raising SHR is contradictory to teachers' right to teach in schools, in which students are considered as the immature who needs to be cared for. Four issues regarding this question are raised. At first, 'can SHR be limited at any condition?'; second, does SHR stand in opposition to teachers' right?'; third, 'are secondary school-aged students immature?; fourth, 'is it blamable to relate SHR into any political intention?' In conclusion, SHR hardly happens to be given at any moment, but is educated, raised, practiced, and formed by consistent training and interactive actions under the condition in which human rights are hihgly considered and respected. Then, HR is itself an education.

이 글은 최근 쟁론화되고 있는 학생인권의 체계적인 교육정책 담론으로 형성되어가도록 쟁점을 분석하고 방향을 제시하는데 목적을 둔다. 학생인권을 신장하는 것이 ‘교육적’인 것을 주장하는 교 사들의 교권과 배치하는 것인지, 여전히 미성숙한 아이들에게 지나친 배려가 아닌지에 대한 질문 을 제기하였다. 주요한 쟁점으로는 다음 네 가지를 제기하였다. 첫째, 학생인권을 제한하는 것은 정당한가? 둘째, 학생인권과 교권은 대립하는 것인가? 셋째, 중등학생들은 미성숙한가? 넷째, 학생 의 정치적 의식화를 어떻게 볼 것인가? 등이다. 결론적으로 학생인권은 어느 한 순간에 주어지는 것이 아니라, 서서히 키워지고, 또 실천함으로써 제대로 누릴 수 있는 그 자체로 교육적인 것이다.
