Oral history interview is a work of joint authorship. The interviewee is a narrator of the oral resource and the interviewer takes on the role of consisting questions for the interview. Thus all of them have copyright interest in the interview which they conduct. In addition, an oral history interview is a literary work, which is protected by the right to reproduce, distribute, transmit to the public, perform and prepare derivative works in the Korean Copyright Act. Legal release agreements are vital instruments for oral historians. They act as legal foundations for using oral history materials and guidelines for protecting the interviewee. The agreements should be made by consent of interviewees and interviewers.

구술사 인터뷰에서 구술자는 이야기 서술의 실질적인 주체로서 창작적인 표현을 만들어내며, 채록자는 적절한 개입과 질문으로 구술의 내용을 풍성하게 한다. 따라서 구술자료는 구술자와 채록자가 함께 만들어내는 공동저작물이고, 구술자료의 적법한 활용을 위해서는 구술자와 채록자 모두의 허락을 필요로 한다. 구술자료는 녹음자료, 녹화자료, 녹취문 등 다양한 형태로 작성이 되지만 그 속성상 모두 어문저작물로 분류할 수 있다. 어문저작물은 저작인격권(공표권, 동일성유지권, 성명표시권)이 부여되며, 저작재산권으로서 복제권, 배포권, 공중송신권, 공연권, 2차적 저작물 작성권이 함께 부여된다. 구술자료에 대한 공개허가서는 저작물 사용의 법적인 근거가 되며, 향후 구술자 보호와 저작물 사용의 가이드라인으로서 역할하게 된다. 자료공개허가서는 향후 저작물 활용의 범위를 고려하여 구체적으로 작성되어야 하며, 구술자와 채록자의 자발적 동의에 의하여 작성되어야만 한다.
