This paper focuses on the legislative conflicts escalated by the low in legislative productivity and party responsiveness, which claim as the major causes of public distrust on the National Assembly. Many scholars blamed divided government for legislative gridlock. This paper is to firstly examine its blame, and to mainly find out one of the major factors of legislative conflicts. At the end, it finally suggests the solutions of legislative conflict in the unified government of 18th National Assembly. By employing John J. Coleman's frameworks such as intraparty factionalism and division, media-related bills passed in 2009 has selected as the object of empirical analysis. This paper finds that the legislative conflict also appears in unified government, and intraparty division between Pro Lee and Pro Park factions within ruling party is one of major factors of legislative conflicts. The finding may be investigated more clearly when applied to the analysis of factional division in the passage of Sejong City Bill.

국회가 국민의 심한 불신을 받고 있다. 다양한 원인이 있겠지만 입법갈등 때문에 국회의 생산성과 효율성이 떨어지기 때문이라고 이해하고자 한다. 입법갈등의 원인을 분점정부에서 찾는 경향이 있지만 본 연구의 목적은 단점정부에서도 입법갈등이 발생할 수 있다는 전제하에 그 원인을 규명하는 데 있다. 콜만(John J. Coleman)이 제시한 당내 분파와 분열이라는 시각에서 단점정부의 입법갈등 원인을 살펴보았다. 이를 위해서 18대 국회의 미디어법 처리과정에 나타난 한나라당의 친이계와 친박계의 당내 계파주의를 경험적으로 분석하였다. 그 결과 입법권과 행정권을 동시에 위임받고 있는 단점정부에서도 입법갈등이 발생할 수 있으며, 당내 계파주의가 입법갈등의 주요 원인의 하나로 작용한다는 사실을 발견하였다. 화합과 상생의 통합적 리더십, 공익과 국민우선의 권력관과 윤리의식 확립 등 당내 분파주의 억제 방안을 제시하였다. 향후 세종시 수정안에 대한 집권세력 내 계파 간 입법갈등을 분석하는 것은 이보다 더 흥미 있는 연구가 될 수 있을 것으로 기대한다.
