The act of electronic device attachment for tracking location of specific crime offenders applies retroactively to those specific crimes committed before the enactment of such law. The Supreme Court of Korea concluded that because the electronic device attachment system has the legal characteristic of preventive restrictions, the principle of retroactive prohibition should not apply. But, the electronic device attachment system should not be treated as preventive restrictions collectively for different types of crimes; rather its application should be analyzed case-by-case, since the mandate of electronic device attachment is another form of punishment even after fully serving the sentences for the crime committed. The principle of retroactive prohibition in criminal jurisprudence serves to protect stability and credibility of legal system. The electronic device
attachment system places restriction on personal liberty and may result in intrusion of privacy due to 24-hour police surveillance, which ultimately results in infringement of legal stability. Thus, the principle of retroactive prohibition should apply and the applicable provision should be eliminated in a timely manner.

특정 범죄자에 대한 위치추적 전자장치 부착에 관한 법률은 위 법 시행 이전의 특정범죄에 대하여 전자장치부착제도를 소급하여 적용하도록 규정하고 있다. 이에 대하여 대법원은 전자장치부착제도의 법적 성격을 보안처분이라고 보고 소급효금지원칙이 적용되지 않는다고 판결하였다. 그러나 위 법률상의 전자장치부착제도는 일괄하여 보안처분이라고 볼 것이 아니라 유형별로 나누어 보아야 하며 특히 징역형 종료 후의 전자장치부착명령은 형벌에 해당한다고 보아야한다. 죄형법정주의의 중요한 원칙인 소급효금지원칙은 국민의 법적 안정성 및 신뢰보호를 위한 것으로, 전자장치부착제도는 행위자의 신체의 자유를 제한하고 24시간 감시체재를 통해 사생활을 침해하는 소지가 있어 이를 소급하여 적용함으로써 법적 안정성 등을 침해하므로, 위 법률의 모든 전자장치부착제도에 대하여 소급효금지원칙은 적용되어야 한다. 그러므로 위 법률의 소급적용조항은 조속히 삭제되어야 할 것이다.
