With the rapid growth of multicultural awareness, multiculturalism is expected to be new issues in the criminal justice system. In term of structural and environmental aspects, multicultural families contain much different factors than Korean Families. It is also predicted that a variety of risk factors such as more serious delinquency, higher recidivism, lower possibility of rehabilitation, and so forth could be serious interruptions when juveniles from muticultural families
are supervised in the criminal justice, particularly in the field of probation. Currently, it appears that supervising juvenile probationers from those families is in the initial and transitional stages. However, multicultural probation cases would be typical examples of juveniles' supervision in the next 3 to 5 years, and the number of them will increase sharply every year. In addition, the
juvenile delinquency rate in the multicultural families is expected to be much higher than the rate in common Korean families. Juvenile probationers from muticultural families may account for 20 to 30 percent of its total probationers, and these proportions are likely to be higher particularly in rural areas or small and medium sized cities. There is no doubt that multicuturalism will set off a debate among individuals involved in the probation system over punishment or rehabilitation. Communication issues, challenges in supervision as well as a high rate of delinquency nuisance will cause people to consider multicultural juveniles as nuisances. In return, these myths may become a common notion and be confirmed in people's beliefs. Eventually, probation could be evaluated as a prime example of discrimination in a muticultural society.
Any decision on how probation deals with the muticultural issues seems to be probation core agenda in the future. There needs to be political considerations on how closed attitudes and communication issues can be overcome in muticutural families and how probation can absorb and integrate such society's characteristics. We need to look to a variety of ways such as creating multicultural support centers, establishing partnership relations with muticultural
companies, recruiting probation officers from muticultural families, etc. Utimately, probation services should be one of the major nation's muticultural policies. Muticulturalism is stepping into the initial stage of Korea society. It is fortunate that we have still much time to prepare for the muticulturalism. We hope successful probation policies for multicultural societies will be established through a number of researches and reviews.

급격한 다문화 진전에 따라 형사사법 분야에서도 다문화는 새로운 이슈가 될 전망이다. 다문화 가정은 구조적, 환경적 측면에서 한국인 가정에 비하여 확연히 다른 요소들을 포함하고 있기 때문이다. 더 많은 비행, 더 높은 재범율, 더 낮은 개선가능성 등은 형사사법, 특히 보호관찰 분야에서 다문화 청소년 지도ㆍ감독에 심각한 고민을 안겨줄 전망이다. 현재는 외국인 여성과의 재혼을 통하여 다문화 청소년 보호관찰 대상자가 발생하는 초기적, 과도기적 형태가 주를 이루고 있으나 향후 3~5년 내에 전형적인 다문화 가정 청소년 보호관찰 대상자들이 등장하게 될 것이며 그 수는 해를 더 할수록 급속히 증가할 것이다. 게다가 다문화 청소년의 비행율은 일반 한국인 청소년의 비행율에 비하여 월등히 높게 나타날 것으로 예상된다. 전체 보호관찰 대상자 중 다문화 가정 출신이 20~30%를 차지할 수도 있으며, 특히 농촌이나 중소도시의 경우 그 가능성은 더욱 높은 편이다. 다문화는 보호관찰 현장에서의 통제와 사회복지에 대한 논쟁을 촉발시킬 것이다. 높은 비행가능성과 함께 의사소통의 한계, 지도ㆍ감독의 어려움 등은 다문화 가정 청소년들을 ‘골치아픈’ 존재로 인식케 할 것이며, 이러한 믿음은 확대 재생산되어 확신처럼 굳
어질 수도 있다. 결국에 가서는 보호관찰이 형사사법 분야에서 다문화 사회의 대표적인 불평등 사례로 평가될 수도 있다. 다문화에 보호관찰이 어떻게 대응할 것인지는 향후 보호관찰의 핵심적인 의제가 될
전망이다. 다문화 가정이 가진 폐쇄성과 언어적 한계를 어떻게 극복할 것이며, 다문화 사회의 특성을 보호관찰에 어떻게 흡수할 것인지는 정책적 고려의 대상이다. 다문화 지원센터를 비롯한 다문화 사업주체들과의 협력관계 구축을 비롯하여 다문화 보호관찰관의 채용에 이르기까지 여러 방안을 검토해 볼 필요가 있다. 궁극적으로는 보호관찰이 국가의 다문화 정책의 주요 변수 중 하나로 편입되어야 할 것이다.
아직은 다문화 사회가 비교적 초기에 머물고 있다. 다문화에 대응할 시간적 여유가 있다는 것은 다행스러운 일이다. 보다 많은 연구와 검토를 통해 성공적인 다문화 사회보호관찰 정책이 구축되기를 희망한다.
