When we think about the purpose of a country's existence, it is obvious that a government must protect culture and nurture cultural life. Therefore, in the perspective in cultural state, welfare for artists is very important and it is artists' welfare law which supports this institutionally. In this point of view, this article examined grounds and necessity of legislating artists' welfare law and also looked uo the details of bill so that suggested assignment which could solve the problem of defining the character of artists as similar labor. For successful enactment legislation of artists' welfare law, firstly, the contents of bill must not be to abstract nor too detail, but delegating the detailed cases to low level, such as enforcement ordinance, enforcement regulations. Secondly, artists' welfare law has to be comprehended as a new law under the certain circumstances. Lastly, the way to legislate artists' welfare law and Korean artists welfare foundation law, separately, should be concerned.

국가의 존재목적을 생각해보면, 국가의 문화보호 및 문화생활의 육성과제는 너무나 당연한 것이다. 따라서 문화국가적 관점에서 예술인의 복지적 측면은 매우 중요하다고 수 있으며, 이를 제도적으로 뒷받침하기 위해서 제정하려고 하는 법률이 바로 ‘예술인복지법’이라 할 수 있다. 이러한 점에서 본 논문에서는 예술인복지법 제정의 필요성 및 근거를 살펴봄과 동시에, 법안의 내용을 구체적으로 살펴보았고, 그 과정에서 예술인의 유사근로자적 성질을 법적으로 어떻게 해결해야 하는가라는 과제를 제기하였다. 그런데 이러한 예술인복지법의 조속하고 성공적인 제정입법을 위하여, 첫째로 법안의 내용은 그리 추상적이지도 않으면서 그렇다고 너무 상세하지도 않게 규정하면서, 구체적인 사항은 하위법인 시행령 및 시행규칙에 위임하는 태도를 견지해야 하며, 둘째로, 기존 관련법과의 관계에서 상황에 따라 예술인복지법의 신법 또는 특별법으로서의 성격을 잘 파악해야 하고, 셋째로 예술인 복지기본법과 한국예술인복지재단법을 분리하여 입법하는 방안도 고려해 볼 수 있다.
