This study explored the causality of legal consciousness and prison life compliance of prison inmates of Korea. There’s a variety of definitions for the concepts of legal consciousness, and this study examined the conceptual framework of legal socialization, which consists of legitimacy, legal cynicism and moral disengagement. Also, this study investigated the effects of legal consciousness to compliance with prison life. The major findings is that the legitimacy(β=.116, p<.01), moral disengagement(β-.156, p<.01), and education level(β=-.156, p<.01) influence inmates' compliance with the prison life. On the other hand, legal cynicism doesn't have significant influence on the dependent variable. Results suggest legal consciousness of inmates is in part developed prior to imprisonment, and such results implicate the following policy alternatives. First, correctional programs based on the self-interest and selfish motivation of inmates are less likely to be effective. Second, correctional programs emphasizing legitimacy of prison regulations and disadvantages of violating prison regulations are more likely to be more effective.

이 연구는 수형자의 법의식 수준과 수형생활 순응도의 관계를 탐색한 연구이다. 법의식은 다양하게 정의되는데 이 연구에서는 정당성(legitimacy), 법 냉소주의(legal cynicism), 도덕적 해체(moral disengagement)를 하위변수로 구성하는 법사회화의 개념틀을 이용하여 법의식을 검토하였다. 또한 법의식수준에 따라 수형생활의 순응에 어떤 차이가 있는지 검토하였다. 연구결과 정당성 인식은 수형생활 순응에 정(+)적인 영향(β=.116)이 p<.01 수준에서 통계적으로 유의미한 것으로 밝혀졌으나, 법 냉소주의는 유의미한 영향을 발견하지 못하였다. 도덕적 해체는 수형생활 순응에 부(-)적인 영향(β=-.156)이 p<.01 수준에서 통계적으로 유의미했다. 한편, 통제변수인 교육수준은 수형생활 순응에 대해 p<.01수준에서 유의미한 부(-)적 영향(β=-.116)을 갖는 것으로 나타났다. 이러한 결과는 수형자의 법의식이 수형이전에 일정부분 형성된 것이라는 점에서 다음과 같은 정책적 대안이 도출된다. 성공적인 수형자의 교화개선을 위해 이익추구 또는 개인의 이기심을 근거로 한 수형규정 거부를 억제하고, 수형규정이 수형자들에게 정당한 것이며, 위반할 경우 개인에게 돌아올 해악이 더 크다는 점을 강조하는 교육프로그램을 지속적으로 실시할 것을 제안한다.
