In recently, there are so many stalking in our society. Some times stalking is caused in suicide of stalking victim and other crimes. Even though the policy and criminal justice system of stalking are very not sufficient. So, I would like to propose about the adequate policies and criminal system and networking with community supporting groups for victims of stalking. By the way, the root of my proposal is supporting system for victims of stalking of america. First, we need legislate law about special stalking prohibition law. especially the law has to include definition, penalty against stalking and victim service. Second, we should to make extra coordinating government office between criminal justice system and community supporting groups for stalking victims. This have an effect on enlargement of citizen mention. Additionally this extra office will make educational guideline for police, prosecutor, attorney and probation officers. We can use Stalking Resource Center of the National Center for Victims of Crime in america. Third, we have to research to the reality of national stalking victimization. It is useful to finding reasons of stalking, victim reasons for not reporting stalking to police, relationship between offenders and victims. Obviously these are helpful to making law and countermeasures. We can use model as a stalking survey of united states in 2006. Fourth, we have to prepare to community networking system. Almost police and prosecutors don't know stalking. Because we have no special stalking law. So they think stalking is private or personal matter or not crime. And many people don't know about community supporting groups and facilities. The role of community networking system is find an ally, and coordinate goals and swap resources with agencies. Especially they have to provide to victims about civil attorneys and shelters and counseling. Fifth, we never discrimination against stalking victims in workplace same to domestic or sexual harassment victims. it is useful to victim reporting to police and get off fear. More over the discrimination prohibit code is including by stalking law like a special law related domestic violence or sexual harassment penalty.

최근 인터넷 상의 스토킹을 비롯하여 직장내 혹은 가족간 스토킹 행위가 광범위하고 일부 연예인의 자살사례에서 보듯 사회적 파장을 불러일으키기도 했지만 여전히 스토킹에 대한 사회적 인식 및 대응책은 더딘 실정이다. 스토킹에 대한 미국의 형사정책 및 사회적 대응을 모델로 스토킹에 대한 처벌 및 피해자를 효과적으로 지원하기 위한 정책적 방향을 다음과 같이 구상해볼 수 있다. 첫째, 인터넷 스토킹을 비롯한 스토킹의 개념정의를 분명히 한 특별법의 제정이 필요하다. 물론 현행처럼 형법상의 명예훼손죄나 모욕죄, 폭행죄, 가정폭력특별법 등으로 처벌이 부분적으로 가능한 경우도 있지만 미국의 경우처럼 특별법을 제정함으로써 처벌을 강화하고, 피해자지원 시스템을 구축하는 근거를 확보할 수 있다. 둘째, 스토킹 피해자 지원을 위한 별도의 정책부서가 필요하다. 즉, 미국의 범죄피해자지원센터의 스토킹대책센터처럼 스토킹에 대한 정보를 제공하고, 스토킹에 대한 사회적 경각심을 불러일으키는 다양한 정책을 제시하는 역할을 기대할 수 있다. 셋째, 스토킹의 피해실태를 정확하게 파악하기 위한 실태조사가 필요하다. 미국은 2006년도에 전미 스토킹 피해실태를 조사함으로써 이후 스토킹 피해자에 대한 지원의 문제점, 형사사법기관에 대한 피해자의 불신이유 등을 파악하여 이를 정책개선에 적극적으로 할용하고 있다. 넷째, 형사사법기관과 지역사회 피해자지원 단체들 간의 연계시스템이 필요하다. 스토킹 사범에 대한 수사기관과 법원, 그리고 보호관찰관에 이르기까지의 형사사법기관 상호간의 정보교환은 물론 피해자지원을 위한 인식을 같이 해야한다. 또한 지역사회의 쉼터나 상담시설 등과의 연계가 필요하다. 다섯째, 스토킹 피해자에 대한 고용주의 불이익을 금지해야 한다. 즉 가정폭력이나 성폭력 피해자의 경우 고용주가 불이익을 줄 수 없도록 관련법에서 규정하고 있는 것처럼 스토킹 피해자에 대한 불이익을 줄 수 없도록 함으로써 스토킹 피해자가 적극적으로 자신의 피해사실을 드러내고 문제를 해결할 수 있는 여건을 만들어야한다.
