Juvenile law amendment from in June 2008 is amended for the juvenile justice system reform around the guide-leader, and diversification -strengthening of juvenile protection policy through increase-division of juvenile protection disposal. However, the suitability of the purpose and effect is questionable of amendment of juvenile law. In addition, the amendment's purpose and problems are opposing opinions. Social atmosphere that was required active countermeasures according to diversification of juvenile crimes. In this study is the juvenile protection policy according to juvenile law amendment to changes in the characteristics of the policy. And Training Attention, Scientific Note, Preventive care is discussed policy changes in the direction. Juvenile protection policy based on the theoretical background of juvenile protection, and to grasp the change issues of that. That is the juvenile protection policy direction to move. This study was based on juvenile protectionism, that is reflected the nature of juvenile law's propose. The significance of this study is presented future direction of juvenile protection policy.

2008년 6월부터 시행된 개정 소년법은 교화․선도 중심으로 소년사법체계를 개편하고, 소년보호처분 확대개편 등을 통해 소년사법의 다양화와 내실화를 꾀하기 위해 개정되었다. 그러나 그 목적과 취지를 제대로 살리는 방향으로 개정된 것인가에 대한 의문도 함께 제기되고 있다. 또한 소년법 개정의 취지와 이에 대한 문제점을 제기한 다양한 견해가 대립된 가운데 소년범죄의 다변화에 따른 적극적인 대처방안을 요구하는 사회적 분위기가 조성되었다. 이 연구에서는 개정된 소년법에 따른 소년보호정책 관점 변화의 특징에 대해 엄벌주의 경향과 보호주의 경향으로 나누어 고찰해보았다. 또한 이에 대한 정책 변화의 방향에 대해 소년보호주의 원칙 중 교육주의․과학주의․예방주의를 근간으로 논의해보았다. 논의의 내용은 소년보호의 이론적 배경을 토대로 소년법 개정으로 인한 소년보호정책 변화의 쟁점과 한계를 파악하여 소년보호정책의 나아갈 방향을 제시하는 것이었다. 이 연구는 소년법의 성격이 반사회성 있는 소년의 보호․육성을 통해 건전하게 성장하는데 있다고 볼 때, 소년보호주의에 바탕을 둔 교육적․인도적․복지적 소년보호정책의 향후 방향을 제시하는데 의의가 있다고 하겠다.
