In recent years, Owing to social influence as economic stagnation and human generic character to rely on chance, various gamble business flow over society and this operate as a main obstacle of social development. With new gamble business occurrence, request to revision of The Gamble Business Regulation Act was more and more and particial revision of The Gamble Business Regulation Act was realized. But that revision was not enough and it is not able to face social evils of gamble business. In this paper, I intend to establish definition of gamble business rationally as theory ground and then, to invest whether "the rest gamble business" of ArticleⅠ Clause1 1. 다. in The Gamble Business Regulation Act is fitted to prohibition to inclusive delegation of legislation or not, and as individual regulation, possibility of regulation of objects big scale gamble without business and I propose necessary of regulation of gamble business through eletronic methods, and additional penalty to gamble business of the young people object, gamble business by internet methods(because its pervasive effect is enormous)

사행행위는 적법성과 불법성을 넘나드는 이중적 성격을 가지고 있어 반드시 나쁜 것이라고 치부할 수는 없으나, 최근 경제 침체 등의 사회적 영향과 요행을 바라는 인간의 고유한 속성 등으로 인하여 사행행위영업이 범람하고 있으며, 이것은 사회 발전의 중대한 장애가 되고 있다. 신종 사행행위 영업의 속출과 함께 사행행위규제법에 대한 개정 논의가 많았으며, 이에 2006년 사행행위규제법은 약간의 개정이 있었다. 그러나 그 개정은 충분치 못하였으며, 작금에 일어나는 사회 병폐적 사행행위영업에 대처하기에는 부족함이 많다. 본 연구에서는 사행행위규제를 위한 가장 기초적인 이론으로서 사행행위의 개념으로부터, 현재 주요 내용을 대통령령으로 위임하고 있는 사행행위규제법 제2조 제1항 제2호 다목의 "그 밖의 사행행위영업"의 규정태도가 포괄적 위임입법금지에 해당하는 것은 아닌지, 또 개별적 규제대상으로서의 영업이 아닌 대규모 사행행위, 컴퓨터 프로그램 등 전자적 방식을 통한 사행행위 등의 규제 필요성에 대해서 언급하고 끝으로 청소년과 인터넷을 통한 사행행위영업의 가중처벌의 필요성을 제시하였다. 본 연구에서는 현재 경찰에서 추진 중인 혁신 현황을 살펴보고, 경찰혁신이 이러한 변화의 과정에서 발생되는 문제점을 충분히 검토하고 분석하여 실질적이고 장기적인 변화를 이끌면서 성공적으로 추진되기 위해서는 경찰이미지 향상, 고객만족 경찰활동, 인권의식 정립과 같은 경찰혁신의 방향이 필요할 것이라고 본다.
