Japan's National Police Agency(NPA) said that police took action in 40,126 criminal cases in which the perpetrator was believed to have been foreigners, down 16.2 percent from the record high logged the previous year. Compared with 1991, Penal Code offenses committed by foreigners in 2006 showed a fourfold increase nationwide, while leveled off in Tokyo, it varied from 1.6-fold to 35-fold in other regions. Of the non-Japanese Penal Code offenders, 13.2% were illegal immigrants. Of the illegal immigrants who committed Penal Code offenses, 32.0% were arrested for felonious offenses, 58.0% for burglary theft and 41.6% for fraud. And those who committed Special Law offenses, 27.7% were arrested for drug offenses and 25.0% for illegal possession of burglary tools. But there was a large drop in cases of suspected theft from cars and vending machines, which contributed to the overall decline, the NPA said, adding that police and volunteer groups have increased street patrols and crime-prevention programs. The NPA attributed the uptrend over the past few years to stepped-up efforts by police to investigate mob-related money flows. The Director for International Investigative Operations, Organized Crime Department is in charge of contact with ICPO-Interpol. Asian and other countries the Mutual Legal Assistance Treaty (MLAT), which would facilitate efficient and effective international investigative cooperation. In August 2003, the Japan-U.S. MLAT was signed, and in January 2006, the Japan-Korea MLAT was signed, too. Also, Japan is preparing for the conclusion of multilateral treaties concerning international investigative cooperation, including the United Nations Convention against Transnational Organized Crime and the Convention on Cyber crime.

2006년 12말 현재 우리나라에 체류하는 외국인수는 91만 여명에 이르고 있으며 이 중 21만 여명이 불법체류자이다. 이처럼 외국인 수가 급격히 증가하면서 외국인관련 국제성범죄도 증가추세를 보이면서 범죄양상도 지능화되는 경향을 나타내고 있다. 특히 불법체류외국인의 수가 지속적으로 늘어나면서 위장결혼, 여권 위·변조, 외국인등록증 위조 행사 등 불법체류 외국인의 국내 합법체류를 목적으로 한 범죄가 끊이지 않고 발생하고 있다. 이처럼 외국인 입국 및 체류자의 증가와 함께 늘어나고 있는 외국인범죄는 우리 사회가 직면하고 있는 큰 문제 중의 하나로 자리 잡고 있다. 따라서 갈수록 확산되고 있는 외국인범죄에 대한 효과적인 대응방안의 마련이 시급히 요구되고 있는 실정이다. 일본에서는 昭和시대에서 平成시대로 옮겨오면서 국내적으로는 거품경기에 의해 경제가 활성화되고 국외적으로는 1989년 중국의 천안문 사태, 독일의 베를린장벽 붕괴, 1991년 소련의 해체 등 세계가 급변하면서 이들 국가로부터 외국인이 일본에 대거 유입되었고, 이때부터 일본에서는 외국인에 의한 불법취업, 매춘 등이 사회적 문제로 대두되었다. 그런데 일본에서는 2005년까지 외국인범죄의 발생건수와 인원이 지속적으로 증가해 왔으나, 2006년에는 증가세가 다소 둔화되거나 또는 감소하는 경향을 보이고 있다. 이는 일본정부가 1980년대 후반부터 심각한 사회적 문제로 부각된 외국인범죄에 적극적으로 대처한 결과라고 할 수 있다. 본 논문에서는 일본에서 외국인범죄의 양상이 어떻게 전개되어 왔으며 일본정부는 외국인범죄에 어떻게 대응해 왔는지를 살펴보고, 우리나라의 상황에 맞는 외국인범죄의 대처방안을 제시하고자 한다.
