An Municipal police system (Jeju Municipal police system and Authority Police Act) that our country makes a request for carrying out in the present bases on Municipal police systems of France, Italia, and Spain, a kind of civil law. The countries have different historic, social circumstances related to autonomy. Especially, there are some differences such as the differences in administrative classes and rights on autonomy, considered on a systematic aspect, as well as the differences in points of view, considered on a recognition aspect. As the aspect, lining up budgets, operating human resource, and confining affairs between the national police and Municipal police have to be solved without fail in importing Municipal police. Considered on the least-limitation police (the concept of police at the most narrow meaning), it is necessary, as the more practical ways for the purpose of importing Municipal police system, in order to solve the problems, to make up for a special judicial police system under enforcement in a large scale and to use Minor Offense Punishment Law and Regulation Order Act. The strong points of the ways are to put into practical use of the current human resources without supplementing human resources in a large scale, to appropriate budges from provincial expenses, and to decrease a burden in supplying implements. In addition, granting a right on Minor Offense Punishment Law and positively putting into a practical use of Regulation Order Act are good ways to keep a basic order of a region. This thesis made a request for analyzing the responsibilities of the police, as the concept of lease meaning, prescribed in Authority Police Act under the current enforcement by gearing down more. This approach was considered on the character of the police(order public). It means that the recognition on the role of the public peace has to be uplifted. That is, public peace is not on only the police, but on all of the groups and inhabitants in a region through a communal productivity. Basing on the approach, this thesis made a request for a model for induction on an autonomous police system.

우리나라에서 도입하고자 하는 자치경찰제의 문제와 관련하여 최협의 개념으로 경찰의 역할을 파악하여 현재 시행 중인 제주자치경찰제도 및 특별사법경찰제도를 중심으로 파악하고자 하였다. 최소한도의 자치경찰이(최협의의 경찰개념) 행정경찰활동이라고 규정하고, 자치경찰제를 정착시키기 위한 현실적인 방안으로서 현재 시행 중인 특별사법경찰제도를 대폭 보완하고 경범죄처벌법, 질서위반행위규제법을 활용하는 방법을 제시하였다. 이러한 방안의 장점은 대규모 인력을 충원하지 않아도 되고 현재의 인력을 활용할 수 있으며, 예산에서도 도비로만 충당할 수 있고, 장비의 지원에 있어서도 부담을 크게 경감할 수 있다. 또한 경범죄처벌법상의 권한 부여 및 질서위반행위규제법의 적극적 활용은 지역의 기초질서 유지를 위한 좋은 방안이 될 수 있을 것이다.
