This study suggests the countermeasure device for maximizing the Korean Advantage through the analysis of the international trends and dispute stands. The dispute among the world wide nations has been continuously generated and the sphere of it will be on the increasing trends. Both Korean government and the enterprise had suffered damage of the intellectual property suits because of the lack of information communication ability, the institutional inertia, and insufficient of negotiation and arbitration ability. Therefore, Korean government and enterprise will persevere their efforts in order to be aware of the importance of managing the intellectual property and also try hard to devise the proper measure for meeting the dispute against the other countries. Through this study some countermeasure device were found such as making up the domestic institution, the exploration of the proper scheme within both government and enterprise, and the continuous request of our suggestion through the continuous talks with the international organization concerned. The study has some limitation that the secondary data originally has. These limitation will be hopely diminished in the next study.

본 연구는 지적재산권의 국제적 동향과 분쟁현황을 분석하여 우리나라의 이익을 극대화하기 위한 대응 방안을 제시하는 것이다. 지적재산권분쟁은 국내외를 막론하고 끊임없이 발생하고 있으며 그 분야도 점점 확대되고 있는 추세이다. 다른 IT 강국에 비해 기술능력은 뛰어나 있음에도 불구하고 지적재산권을 지키기 위한 선진 IT 강국과의 정보소통능력 부족, 관련 대응 기구 미비, 협상 및 조정 능력 부족으로 말미암아 우리나라의 정부나 기업들은 소위 말하는 '특허괴물'과의 소송에서 패소하여 경제적 손실을 입는 경우가 많다. 따라서 지적재산권 관리의 중요성과 분쟁 시 정부나 기업이 적절한 대응을 통해 국가 이익에 부합되도록 노력해야 한다. 우리가 대응할 수 있는 방안은 첫째, 국내제도의 보완 둘째, 정부 및 기업의 적절한 대처방안 모색 셋째, 국제적 기구와의 끊임없는 커뮤니케이션을 통한 우리 의견반영 요구 넷째, 사용자들의 인식개선 등이다. 본 연구가 가지고 있는 한계는 2차 자료만을 가지고 분석에 임했다는 점이다. 추후 연구를 통하여 관계 당사자를 대상으로 심층분석을 진행하고자 한다.
