Intellectual property protection and enforcement are emerging as dominant priority for the global trade policy. Each States are taking further step to improve TRIPS-Plus level of intellectual property right protection. This article analyzes Dutch border measures against generic drugs in transit from India to Brazil in 2008 and thereby catches current situation of border measure. To achieve this, it will be examined Art. Ⅴ of GATT Agreement provisions relating to border measures of TRIPS Agreement, position of States in question, WTO Agreements consistency of Dutch border measures and EU Regulation 1383/2003, and goods in transit in ACTA.

전 세계적으로 각 국의 지적재산권 보호는 점차 강화되고 있으며, 그집행 역시 TRIPS-Plus 수준으로 이는 ACTA 협상에도 반영되어 있다. 본고는 2008년 인도, 브라질과 EU 간의 제네릭 의약품 압류조치 분쟁을 검토함으로써 국경조치의 현 주소를 파악하고자 한다. 이를 위하여 GATT협정 제5조 통과의 자유 및 TRIPS 협정상의 국경조치에 대한 검토와 더불어 분쟁 당사국의 입장, 문제된 네덜란드의 조치 및 EU의 Regulation 1383/2003이 WTO 제협정에 위반되는 부분이 있는지 여부, ACTA에서의 논의 역시 차례로 살펴보기로 한다.
