　Agreement on Safeguards came into being after long negotiations. This agreement seems to be contained the comprehensive applicable rules on safeguard measures. However, the Appellate Body ruled that Article XIX of GATT is applicable with the Agreement on Safeguards.
As a result of the Appellate Body resolution upon this issue, the Applicability of safeguard measures is threatened, moreover, it makes the WTO members to circumvent the existing rules to protect their domestic industry. Thus the revival of Article XIX was not only to its provisions, but also for the illegal practices, which motivated the WTO agreement drafters to create the Agreement on Safeguards．
