On 25 Feb. 2010, the Constitutional Court of Korea examined whether the death penalty system is constitutional based on the ruling in 1996, which was the 7 to 2 decision. It seemed that the ruling was the opportunity to scrutinize its constitutionality because it has been 14 years since the last judgment regarding death penalty, thereby drawing the public's attention. The relevant case, dealt with constitutionality of death penalty, was about the murder. In the case, a seventy-year old fisher, Mr. Oh, with the charge of murder of four people around the Cheonam Boseong coast area, appealed to the Kwangju High Court. On 26 Sept. 2008, the defendant argued in the appeal court that Articles 250 and 41 of the Criminal Law, regarding death penalty, violated the Constitution, and the court accepted his argument and requested the Constitutional Court to rule on the constitutionality of the relevant regulation. In fact, there are condemned criminals of death penalty, but since 29 Dec. 2007, there has been no execution of criminals; thus, Korea has obtained the status of "Abolitionist in Practice" by the International Amnesty. For that reason, the judgment drew the people's attention. The Constitutional Court's judgment on 25 Feb. 2010 concluded by five to four that the death penalty system is constitutional. This article intends to discuss about the Constitutional Court's judgment and its interpretation of the relevant Criminal Law and policies on criminal law based on justice perspectives, thereby arguing the problem of the existence of death penalty. At the same time, it aims to compare the diverse jurisdictions: the US has indicated her faith in the death penalty system; China has known as one of the most active countries, which perform execution of criminals; and Japan has a similar structure of legal system of Korea. Following this comparative study, this article concretely examines the issue about death penalty and its validity. Lastly, this research scrutinizes its current development around the world, thereby agreeing with the assertion that the abolition of death penalty is universally humanistic and also rational.

사형제도의 위헌성에 대하여, 2010년 2월 25일 헌법재판소가 1996년 사형제도에 하여 7: 2 합헌 판결이 내려진 14년 만에 다시 판단할 수 있는 계기가 있어, 세간의 관심이 모여지게 되었다. 사형제도에 대하여 위헌성 여부가 판단될 수 사건은 전남 보성 앞바다에서 4명의 남녀를 살해한 혐의로 광주지방법원 순천지원에서 사형선고 된 70대 어부 오모씨가 광주고등법원에 항소하고 당해 항소법원에 2008년 9월 26일 형법 제250조, 형법 제41조에서 사형을 규정하고 있는 것이 헌법에 위배된다는 주장을 하자, 당해 수소법원이 이를 받아들여 위헌법률심판제청을 함으로서 만들어지게 되었다. 사실 우리나라는 사형이 확정된 수형자가 존재하고 있지만, 2007년 12월 29일의 사형집행을 끝으로 현재까지 약 13년간 사형을 집행하지 않아, 국제 엠네스티로부터 ‘사실상 사형폐지국가(Abolitionist in practice)’라는 지위를 얻고 있어, 당해 헌법재판소의 결정은 매우 큰 관심의 대상이 되었다. 이에 대하여 우리 헌법재판소는 2001년 2월 25일 사형제도에 대하여 5:4 합헌 결정을 하였다. 본 논문에서는 헌법재판소가 사형제도에 대하여 합헌적으로 해석한 점에 대하여, 형법 및 형사정책적 관점 및 정의론적 관점에서 문제점을 지적하여, 사형제도 존치의 허구성을 논증함과 동시에 사형제도에 대하여 여전한 신뢰를 보이고 있는 미국에서의 논의와 사형이 가장 많이 시행되고 있는 중국 및 우리와 가장 비슷한 법제를 가진 일본에서 사형제도에 관한 논의를 구체적으로 살펴, 다시금 사형제도의 타당성을 논증하여 보기로 한다. 마지막으로 사형제도에 대한 세계적 추이를 검토함으로써, 인권적 차원에서 사형제도의 폐지를 인정하고자 하는 인류보편적 타당성에 관한 목소리를 경청해보고자 한다.
