According to spam mail's rapid increase following Internet and Email users' global increase, it is appeared as serious social issue and also, it gives damage against customer's trust, which treats E-commerce's foundation in the world wide level together with other security problems such as hacking, virus, etc. The major reason, which spam mail has been increased, is to be used as the cheapest Direct Marketing method according to its related transmitting technology development to randomly collect and transmit email. Because various problems occur from spam increase by related technology development, numerous economic expenses such as network overload, time loss, productivity's deterioration, etc. as well as privacy invasion, identify stealth have been shown up. Because such various problems occur by spam mail increase resulted from Internet's global support, governments, private organizations, and related business sectors all around world have made various efforts to solve spam problems. In the below section, this study mainly examined how Europe and Germany try to the problems in the lawful and systematic aspect and also, thought about Korea's correcting direction based on law and system correcting direction. Of course, since spam includes various related problems, it is difficult to be solved only by law and system, in which various related entities should make comprehensive efforts to solve it.

전 세계적으로 인터넷과 이메일 이용자가 증가하면서 아울러 스팸도 급증함에 따라 심각한 사회문제로 대두되고 있으며, 소비자 신뢰를 훼손함으로써 해킹․바이러스 등 다른 시큐리티 문제와 함께 전 세계적으로 전자상거래 기반을 위협하고 있다. 스팸이 증가하는 주요 이유는 그것이 가장 저렴한 Direct Marketing의 수단으로 사용된다는 점과 온라인 상에서 무차별적으로 이메일을 수집하고 전송하는 기술이 발달했다는 점이다. 이러한 기술의 발달로 인한 스팸의 증가로 인해 다양한 문제가 초래되고 있는 바, 스팸으로 인한 네트워크 과부하, 시간 및 생산성의 낭비 등 막대한 경제적 비용뿐만 아니라, 프라이버시 침해, Identity 도용 등의 문제가 발생하고 있다. 인터넷 이용의 확산과 함께 스팸도 더불어 증가하여 다양한 문제를 야기하자, 각국 정부, 민간단체 및 관련 업계에서는 스팸 문제를 해결하기 위해 다양한 노력을 기울이고 있다. 이하에서는 유럽과 독일의 법․제도적 해결노력을 중심으로 살펴보고, 우리나라의 법ㆍ제도적 개선방향을 고찰하였다. 물론 스팸은 다양한 문제를 포함하고 있어, 법 제도만으론 해결이 곤란하고 여러 관계자의 종합적인 노력이 필요할 것이다.
