1990년대 이후로 해상 교통의 요충지인 말라카해엽과 동남아시아와 소말리아 해역을 중심으로 자행되고 있는 선박납치 등 해상 테러리즘은 최근 들어 더욱 조직화 되고 흉악화 되어가고 있는 추세이다. 2009년 소말리아 해역에 청해부대를 파병한 이후 잠잠했던 한국인 피해도 2010년 원유운반선 삼호드림호가 피납 되어 아직까지도 석방교섭이 완료되지 않고 있는 실정이다. 특히 삼면이 바다로 둘러싸여있고 우리나라의 수출입 물량의 대부분이 해상을 통해 운송되고 있어 해상의존도가 높은 나라이기 때문에 해상 테러리즘에 대한 대응의 필요성은 아무리 강조해도 지나치지 않다 할 수 있으나 이에 상응한 해양안보역량을 충분히 갖췄다고 보기 힘든 상황이다. 우리나라도 해상테러리즘으로부터 국적선 및 국민의 소중한 생명을 보호하기 위한 대책을 수립하여야 한다. 따라서 본고에서는 현재 전 세계적으로 자행되고 잇는 해상테러리즘의 위협요인과 발생상황을 살펴보고 이를 토대로 제도적 법적 대응방안을 고찰해봄으로써 향후 우리나의 해상 테러에 대한 시사점을 도출하고자 한다.
