The most important thing in criminal identification procedures is not only to point out the criminal correctly but also to prevent the innocent people from getting unfair punishments. In other words, the efforts and rational procedures of investigative agencies including police can identify the true culprit but they can also make innocent people be falsely accused. The purpose of this study is to understand the real state and problems of existing criminal identification system and to propose efficient management strategies for accurate criminal identification in police investigation. The problem of the current criminal identification system is that the credibility of the identification statement is decreased due to investigators' lack of awareness, unjust prejudice or inappropriate implications during the identification process. And, another problem is human's limited memory. For solving such problems efficiently, it is necessary to seek ways to eliminate prejudice or implications in order to increase credibility and clear awareness of the criminal identification system. Also, apart from the investigators in charge of the case, a group of experts dedicated for the identification procedures must be trained and educated. In order to increase the accuracy of criminal spotting, the suspects and their pictures used during identification statements must be updated constantly and made into database.

범인식별절차에 있어 중요한 것은 범인을 정확하게 지목하는 것 못지않게 죄 짓지 않은 자에게 억울한 형벌이 과해지는 것을 예방하는 것이라고 할 수 있다. 이것은 경찰을 비롯한 수사기관의 노력과 합리적인 절차에 의한 진행이 때로는 진범을 가려내거나, 때로는 정 반대로 무고한 사람을 억울하게 만들 수도 있는 것을 의미한다. 따라서 이 연구에서는 경찰수사에서 범인식별이 정확하게 이루어질 수 있도록 하기 위하여 현행 범인식별시스템 운영상 특징과 문제점을 파악하고, 효율적인 운영방안을 제시하였다. 현행 범인식별시스템 운영의 문제점으로, 먼저 운영 · 절차적 측면에서 수사관들의 행태로 기존 수월했던 관행을 추구하여 증거가치를 확보하지 못하는 점을 들 수 있고, 또한 식별절차에서 부당한 편견이나 부적절한 암시로 인해 범인식별진술의 신빙성을 하락시키고 있으며, 진술자의 상황에 따른 한계로 목격당시의 상황이나 감정 상태 등 증언의 정확성에도 한계를 드러내고 있다. 또한 법 · 제도적 측면에서 범인식별진술에 대한 수사규범이 미비한 점과 식별진술의 오류를 제어할 수 있는 제도의 미비점, 목격자의 처우에 대한 제도의 미비점 등을 들 수 있다. 이와 같은 문제점을 해결하기 위한 방안으로 운영 · 절차적 측면에서는 기존 관행을 탈피하기 위한 교육을 내실있게 꾸준히 진행하여야 할 것과 편견을 배제하고 신빙성을 제고하기 위한 면담기법을 개발하여 수사관 스스로 습득해 이를 실무에 적용할 것을 권고하였다. 또한 법 · 제도적 측면에서는 암시성 배제를 위한 범인식별절차 진행 전문수사관을 육성하여 이들을 범인식별진술절차에서 해당 수사관과 별도로 진행시킬 수 있도록 활용하여야 할 것과 사건의 실체진실 발견과 목격자 진술의 신빙성을 더욱 높이기 위하여 다수목격자를 확보하기 위한 제도가 마련되어야 할 것을 제시하였으며, 특히 현행 불법체류외국인과 같은 지위에 있는 목격자의 처우에도 신경써야 할 것을 주문하였다. 그리고 범인지목의 정확성을 높이기 위하여 식별진술시 사용하는 들러리들을 실물이건, 사진이건 꾸준히 업데이트하여 데이터베이스화 시켜야 할 것을 제시하였다.
